The European citizens initiative as the first element of the direct democracy -opportunities and challenges

Abstract:

Tato diplomová práce se zabývá institutem Evropské občanské iniciativy, která vychází z primárního práva Evropské unie a dává možnost občanům EU předložit Komisi návrh na vytvoření legislativy. Na základě teorie institucionalismu pracuje tato práce s tezí, že Komise má zájem na zachování svojí iniciační kompetence bez prvků přímé demokracie, a proto je očekáváno, že nastavení systému evropské občanské iniciativy nebude k zapojeným organizacím vstřícné. Cílem této práce je zjistit, jestli nastavení tohoto nového systému není příliš rigidní, tedy že je nastavení podmínek iniciativy pro participující subjekty příliš komplikované ke splnění a z toho důvodu nemohou vytvořené iniciativy uspět. K tomu účelu slouží výzkumná otázka: Existují prvky (jaké) nastavení evropské občanské iniciativy, které vedou k nemožnosti úspěšně naplnit podmínky platnosti iniciativy? Práce je rozdělena do několika celků. První část práce bude obsahovat analýzu primárních a sekundárních zdrojů. Bude v ní tedy obsaženo teoretické ukotvení problematiky evropské občanské iniciativy – ukotvení v rámci evropského politického systému, stanovení teoretických problémových oblastí atd. Druhá část práce má formu empirického výzkumu probíhajícího v rámci v té době již ukončených evropských občanských iniciativ. Tento výzkum pobíhal pomocí dotazníkového šetření. Jediné omezení pro zahrnutí iniciativy do výzkumu je lhůta pro sběr prohlášení o podpoře, tedy únor roku 2014. Toto nastavení zajišťuje pestrou škálu iniciativ a to nejen z tématického hlediska, ale i z hlediska mezinárodního zastoupení. Samotný sběr dat probíhal až po uzavření prvního kola iniciativ. Bylo tedy možné konstatovat, která z iniciativ dosáhla požadovaného počtu hlasů, jelikož by již měly být známy oficiální statistiky. Následně byly srovnány jak teoretické, tak praktické poznatky vycházející z tohoto výzkumu. Výsledkem této práce je objektivní zhodnocení limitů nastavení parametrů evropské občanské iniciativy vycházející jak z primárních a sekundárních zdrojů, ale i přímého šetření mezi iniciativami.

Abstract:

This thesis deals with the Institute of European citizens' initiative , which is based on primary law of the European Union and gives EU citizens the opportunity to submit to the Commission a proposal for the creation of legislation. Based on the theory of institutionalism operates this work with the thesis that the Commission is keen to maintain its initiation competence without elements of direct democracy , and it is expected that the setting of the ECI will be helpful to organizations involved . The aim of this work is to determine whether the setting of this new system is too rigid , thus the settings of the conditions initiatives for stakeholders to meet are too complicated and therefore initiatives can not be developed i to succes. For this purpose, there is research question : Are there any elements (which ) of setting of the ECI , which leads to the inability to successfully fulfill the conditions of the initiative? The work is divided into several units . The first part includes an analysis of the primary and secondary sources . It casts a theoretical point issues of the ECI - anchored in the European political system, determination of the theoretical problem areas, etc. The second part takes the form of empirical research undertaken by the already completed European citizens' initiatives . This research was running through a questionnaire survey. The only restriction for inclusion of initiative into the research was the time period for collecting of statements of support, ie February 2014. This setting provides a wide range of initiatives, not only from a thematic point of view but also in terms of international representation. The actual data collection took place after the conclusion of the first round of initiatives. It can therefore be concluded that the initiative has achieved the required number of votes, as it should already be known to official statistics. The result of this work is to objectively assess the limits set parameters of European citizens' initiative coming from both primary and secondary sources, as well as a direct survey of initiatives.
