The Land Value at Expropriation

Abstract:

Cílem diplomové práce je popsat současný stav vyvlastnění v České republice, Německu a Velké Británii s důrazem na stanovení náhrady a aplikovat poznatky na aktuální případ z České republiky. Vyvlastnění je upraveno v zákonech jednotlivých zemí. V praktické části je popsán aktuální případ, který je nyní ve fázi dohody. Pokud se zúčastněné strany nedohodnou, nastane fáze vyvlastnění. Pro ocenění nemovitosti ve fázi vyvlastnění byl použit porovnávací způsob. V České republice se totiž cena obvyklá určí primárně porovnáním. V Německu je při určení tržní hodnoty doporučován porovnávací způsob. Při ocenění nespecializovaného majetku, kam spadá i oceňovaný pozemek s halou, se ve Velké Británii používá porovnávací způsob. Náhrada tak vyšla podle postupů používaných v jednotlivých zemích na stejné úrovni.

Abstract:

The aim of the thesis is to describe the current state of expropriation in the Czech Republic, Germany and Great Britain with an emphasis on the determination of compensation and to apply the findings to a current case from the Czech Republic. Expropriation is regulated in the laws of each country. The practical part describes a current case which is now in the agreement phase. If the parties involved do not reach an agreement, the expropriation phase occurs. The comparative method was used to value the property in the expropriation phase. In the Czech Republic, the normal price is determined primarily by comparison. In Germany, the comparative method is recommended for determining the market value. In the United Kingdom, the comparative method is used for the valuation of non-specialised property, which includes the valued land and hall. According to the procedures used in the different countries, the compensation came out at the same level.
