Misdemeanors and administrative offenses under the Act of Trades lisence

Abstract:

Samotný úvod diplomové práce, jehož téma zní: „Přestupky a správní delikty podle zákona o živnostenském podnikání“, je věnován historickému shrnutí právní regulace živnostenského práva. Dokládáno je tak mapováním vývoje od dob feudalismu až po současnost. Práce je rozdělena do sedmi hlavních kapitol. Následující druhá, třetí a čtvrtá kapitola se zaobírají výkladem obecných pojmů spojených s podnikáním, vymezením podmínek provozování živnosti a druhu živností a současné živnostenské úpravě. Dále je zmíněna úloha živnostenských úřadů v České republice. V páté kapitole je vymezena kontrola jako taková, charakterizovány jsou její základní principy včetně vymezení právního rámce. Šestá a sedmá kapitola se zaobírají protiprávním jednáním podnikatelů, jež živnostenský zákon označuje souhrnně správními delikty. Tyto se dělí dle povahy subjektu na přestupky, které zahrnují porušení fyzických osob bez podnikatelské činnosti a správními delikty, kde porušení právních povinností se týká podnikajících právnických a fyzických osob. Obě kapitoly jsou doplněny statistickými daty. S ohledem na začlenění právní úpravy správních deliktů do zákona od 1.8.2008 jsou tyto údaje mapovány v rozmezí let 2009 až 2010. Směr vývoje je z nich patrný. V samotném závěru je zhodnocena a shrnuta platná právní úprava a uvedeny vlastní závěry a návrhy k problematice správního trestání v oblasti živnostenského zákona.

Abstract:

The actual introduction of the thesis, the theme will be violations and administrative violations under the Act on Trade is dedicated to the historical summary of the legal regulation of trade law. Body of material is the mapping of development since feudalism to the present. The work is divided into seven main chapters. The following third and fourth chapter deals with the interpretation of general concepts of entrepreneurship, defining the operating conditions of trade and type of trades and the current trade arrangements. It is also mentioned the role of trade offices in the Czech Republic. The fifth chapter is defined control as such, is characterized by its basic principles, including establishing a regulatory framework. The sixth and seventh chapter deals with unlawful business conduct, which collectively refers to the Trade Act administrative penalties. These are divided according to the nature of the subject offenses, including violation of FO no business activities and administrative penalties where breaches of obligations relates to corporate business and individuals. Both chapters are supplemented by statistical data. With regard to the integration of administrative law to torts law from 1.8.2008 the data are mapped between the years 2009 to 2010. The trend is evident from them. In conclusion, it is evaluated and summarized existing rules and set their own conclusions and proposals on the issue of administrative punishment in the Trade Act.
