Legal effects of the annulled administrative decision in an action against that decision to administrative court, if the judgment of the administrative court annulled the proceedings on the cassation complaint.

Abstract:

Cílem této diplomové práce je analyzovat jeden z vybraných problémů vztahu správního soudnictví a činnosti správních orgánů - otázku právních účinků rozhodnutí správního orgánu, které bylo zrušeno v řízení o žalobě proti tomuto rozhodnutí krajským soudem, byl-li rozsudek krajského soudu následně zrušen v řízení o kasační stížnosti Nejvyšším správním soudem. Vedle hlubšího rozboru tohoto problému bylo dílčím cílem práce pokusit se identifikovat jeho možná řešení, a to jak za využití stávající právní úpravy, tak v rámci návrhu možných legislativních změn. Analýze byla v první řadě podrobena otázka znovunabývání účinků rozhodnutí správního orgánu, přičemž na základě přijatých závěrů byl v další částí práce podroben rozboru související problém s možností souběžné existence dvou rozhodnutí v téže věci a zkoumány možnosti jeho řešení. Výsledkem této práce je doporučení možných legislativních změn, neboť stávající právní úprava neposkytuje žádná vhodná řešení traktovaného problému.

Abstract:

The aim of this thesis is to analyze one of the selected problems related administrative justice and of administrative authorities - the question of the legal effects of the administrative decision, which was annulled in court proceedings against the decision of the administrative court, if the judgment of the administrative court subsequently overturned in of cassation complaint Supreme Administrative Court. Besides a deeper analysis of this problem is partial to work to try to identify its possible solutions, both using existing legislation and in the design of possible legislative changes. Analysis is primarily a question of re-subjected to the effects of the acquisition of administrative decisions, and based on the conclusions reached shall be analyzed with the related problem of the coexistence of two decisions in the same case and examined its possible solutions. Result of this work is the recommendation of potential legislative changes, as the current legislation is not sufficient in this respect.
