The Utilitarian Approach to Morality and Law

Abstract:

Tato bakalářská práce se zabývá principy klasického utilitarismu a jeho důsledky pro morálku a spravedlnost. Autor se nejprve zaměřuje na popis historického vývoje normativní etiky založené na pocitu slasti. V dalších dvou nejdůležitějších kapitolách dochází k představení výchozích premis a principů, zakládajících utilitaristickou doktrínu, v dílech jeho čelních představitelů, jimiž jsou Jeremy Bentham a John Stuart Mill. Autor dále představuje Benthamovy myšlenky v oblasti trestního práva a zákonodárství a také Millovo vymezení ideální svobodné a otevřené společnosti. Poslední kapitola se věnuje zejména kritické pozici Kantovy transcendentální etiky a poukazuje na některé problematické aspekty utilitarismu.

Abstract:

This bachelor´s thesis deals with the principles of classical utilitarianism and its consequences for morality and justice. At first, the author focuses on the description of historical development of normative ethics based on perceptions of pleasure. In the two further and most important chapters follows an introduction of the fundamental premises and principles which constitute the utilitarian doctrine, in the works of its leading representatives, Jeremy Bentham and John Stuart Mill. The author further introduces Bentham´s ideas in the area of criminal law and legislature, and also Mill´s definition of the ideal free and open society. The last chapter deals in particular with the critical position of Kant´s transcendental ethics and points out some of the problematic aspects of utilitarianism.
