Postmodern problems of human rights and global security

Abstract:

Tato diplomová práce se zaměřuje na aktuální otázky týkající se lidských práv a kybernetické bezpečnosti v kontextu postmoderního paradigmatu. Analyzuje se, jak postmodernismus ovlivňuje chápání univerzálnosti a relativnosti lidských práv a jaké výzvy přináší pro jejich uplatňování v rozmanitých kulturních a historických kontextech. Dále se práce zabývá otázkami moci, identity a rozmanitosti v souvislosti s lidskými právy, s důrazem na postmoderní pohledy na tyto pojmy a jejich vztah k právnímu prostředí. Ve druhé části se zkoumá problematika národní bezpečnosti v souvislosti s mezinárodní spoluprací. Analyzují se bezpečnostní strategie a opatření potřebná pro ochranu státu a jeho občanů, s důrazem na jejich soulad s mezinárodními právními standardy a úmluvami týkajícími se lidských práv. Dále se zkoumají aspekty mezinárodní spolupráce v oblasti kybernetické bezpečnosti a ochrany lidských práv, s ohledem na transnacionální povahu moderních hrozeb. Poslední část práce se věnuje současným hrozbám v digitálním prostředí a jejich dopadu na lidská práva. Analyzují se formy kybernetického napadení a zranitelnosti digitálních systémů v kontextu práva na soukromí a ochranu osobních údajů. Dále se zkoumá, jak právní předpisy a mezinárodní dohody ovlivňují ochranu osobních údajů a svobodu na internetu. V závěrečné části práce je provedena SWOT analýza současného stavu kybernetické bezpečnosti a jejího vlivu na lidská práva. Na základě této analýzy jsou formulována doporučení a strategie pro zlepšení ochrany lidských práv v digitálním prostředí, s důrazem na právní přístupy a nástroje. Celkově práce přispívá k hlubšímu porozumění současné problematiky lidských práv a kybernetické bezpečnosti z právního hlediska a nabízí konkrétní doporučení pro budoucí kroky v této oblasti.

Abstract:

This thesis focuses on current issues related to human rights and cyber security in the context of the postmodern paradigm. It is analyzed how postmodernism affects the understanding of the universality and relativity of human rights and what challenges it brings for their application in diverse cultural and historical contexts. Furthermore, the work deals with issues of power, identity and diversity in connection with human rights, with an emphasis on postmodern views of these concepts and their relationship to the legal environment. The second part examines the issue of national security in connection with international cooperation. Security strategies and measures needed to protect the state and its citizens are analyzed, with an emphasis on their compliance with international legal standards and conventions related to human rights. Furthermore, aspects of international cooperation in the field of cyber security and human rights protection are explored, taking into account the transnational nature of modern threats. The last part of the work is devoted to current threats in the digital environment and their impact on human rights. Forms of cyber attacks and vulnerabilities of digital systems are analyzed in the context of the right to privacy and protection of personal data. It also examines how legislation and international agreements affect the protection of personal data and freedom on the Internet. In the final part of the thesis, a SWOT analysis of the current state of cyber security and its influence on human rights is carried out. Based on this analysis, recommendations and strategies are formulated for improving the protection of human rights in the digital environment, with an emphasis on legal approaches and tools. Overall, the work contributes to a deeper understanding of the current issue of human rights and cyber security from a legal point of view and offers concrete recommendations for future steps in this area.
