Specificities of Administrative Procedures in Competence of Land Register Authority

Abstract:

Cílem této práce je zaměřit se na právní aspekty dvou vybraných správních řízení před katastrálním úřadem s důrazem na jejich specifika. Obecné správní řízení je upraveno zákonem číslo 500/2004 Sb. V jednotlivých předpisech správního práva mohou být upraveny speciální postupy, které mají svá specifika. Obecné správní řízení se použije tehdy, pokud zvláštní předpis nestanoví něco jiného. Zvláštním předpisem na úseku katastru nemovitostí ve vztahu k specifikům je zákon číslo 265/1992 Sb. a zákon číslo 344/1992 Sb. V této práci je hlavní pozornost věnována správnímu řízení o povolení vkladu a správnímu řízení o opravě chyb v katastrálním operátu. V řízení o povolení vkladu se rozhoduje o právu subjektů vlastnických a jiných věcných práv. Toto řízení je nejčastějším a dle mého názoru jedním z nejvýznamnějších správních řízení, se kterým se můžeme v rámci řízení před katastrálním úřadem setkat. Mezi hlavní specifika v řízení o povolení vkladu patří dle zákona číslo 265/1992 Sb. vymezení účastníků řízení.Tento zákon okruh účastníků vyčerpávajícím způsobem vymezuje, proto se nepoužije vymezení účastníků řízení obsažené ve správním řádu. K dalším specifikům patří náležitosti návrhu na vklad a jeho přílohy, rozhodování o povolení nebo zamítnutí návrhu na vklad.

Abstract:

The aim of this work is to focus on legal aspects of two selected administrative proceedings before the Land Registry Office, with emphasis on their specifics. General administrative procedure is governed by Act No. 500/2004 Coll. The particular rules of administrative law may be covered by special procedures which have their specifics. General administrative procedure shall apply if a specific ruling determines otherwise. Special regulation on the real estate register sector is, in relation to the specifics, Act No. 265/1992 Coll. and Act No. 344/1992 Coll. This work is mainly concerned about administrative procedures for concession of a deposit and administrative procedures for rectification of errors in the real estate register. In the procedure for deposit concession is decided about the subject rights of property and other jus in re rights. This procedure is the most frequent and in my opinion, presents one of the most important administrative proceedings which we can meet before the Land Registry Office. Among the key features in the concession of a deposit belongs, according to the Act No. 265/1992 Coll., definition of the juristic person.This law exhaustively defined the circle of the participants, that´s why is not further used definition of the juristic person which is included in the administrative order. Other specifics include the terms of proposal for deposit and their annexes, the decision for permission or rejection of the proposal for deposit.
