Proportionality Principle: Theoretical Foundation and Practical Application

Abstract:

Cílem předkládané práce je zmapovat původ principu proporcionality v kontextu aplikace základních práv a svobod a kriticky jej zhodnotit. První tři kapitoly se proto věnují popisu jeho koncepce u některých významných autorů (Holländer, Alexy, Kühn) a současně podávají několik příkladů z judikatury různých soudů. Kritické zhodnocení je možno učinit při podrobné analýze původu principu proporcionality v teorii práva. Kapitola 4. se proto věnuje teorii právních principů u Dworkina a naznačuje jejich pojetí hlouběji v klasické tradici evropské morální filozofie a práva. Tato tradice je pak nejzazším rámcem jak kritiky Alexyho teorie (aplikace) základních práv, kterou se zabývá 5. kapitola, tak i kritiky principu proporcionality z hlediska jeho deficitu politické legitimity v demokratickém právním státě v 6. kapitole. Závěrečná 7. kapitola s určitými zobecněními shrnuje získané poznatky.

Abstract:

The aim of this thesis is to explore the origin of a principle of proportionality in the context of application of fundamental rights and freedoms and to evaluate it critically. The first three chapters are devoted to the description of its conception defined by some eminent authors (Holländer, Alexy, Kühn) and, at the same time, to some illustrative examples of judicial decisions of various courts. A critical evaluation can be made in a thorough analysis of the principle of proportionality origin's in a theory of law. Therefore, the fourth chapter deals with Dworkin's theory of legal principles and further indicates their conception profoundly within the classic tradition of European moral philosophy and law. This tradition provides an ultimate framework for a criticism of both Alexy's theory of (application of) fundamental rights (the fifth chapter) and of the principle of proportionality as such (the sixth chapter), herein focusing on its deficiency in political legitimacy in a democracy under the rule of law. The final (seventh) chapter sums up the conclusions with some generalizations.
