The so called Two-year Legal Plan and its Influence on the Concept of Rights in Rem

Abstract:

Tématem předkládané diplomové práce je porovnání pojetí věcných práv dle římského práva a dle práva lidové demokracie. Úvodem se práce zabývá historickými událostmi, které vedly ke změně v úpravě občanského práva a popisuje stav kodifikace na území Československa v období převratu, v únoru 1948. Následuje vysvětlení pojmu „právnická dvouletka“ a stručná charakteristika práce kodifikačních komisí. V dalších kapitolách se nachází popis věcných práv dle úpravy občanského zákoníku vzešlého z roku 1950. Práce je uzavřena porovnáním obou pojetí a zamyšlením nad návratem k římskoprávní tradici.

Abstract:

The aim of this thesis is the comparison of rights in rem interpretation of Roman law and the socialist concept. The introduction covers the historical affairs that led to a change in the regulation of civil law and describes the condition of codification in Czechoslovakia after the communist putch in February 1948. Following the affairs is the explanation of the term “The so called Two-year Legal Plan” and brief characteristics of codification commissions. The description of rights in rem, as described by the socialist civil code follows in next chapter. The thesis concludes of the comparison of these two approaches and takes into account the challenges of following Roman-law tradition.
