Administrative Punishment Against Foreigners

Abstract:

Důvodem proč jsem si vybral téma „Správní trestání cizinců“, je především ten, že v dnešní době si už neumíme představit život bez přítomnosti cizinců v České republice. K této situaci přispívá i nepříznivý demografický vývoj v naší společnosti a vůbec v celé Evropské unii. Patrné je to zejména v číslech průměrné porodnosti v naší zemi, která patří ve srovnání s Evropskou unií na jedno z posledních míst. Se skutečností, že postupně vymíráme, jsme se již smířili, a jak vidno tak i naší zákonodárci, kteří nepodnikají žádné kroky k tomu, aby tento nepříznivý trend zastavili. S tím jak vymíráme, pak souvisí i potřeba určitým způsobem doplňovat naši populaci a zvolili jsme stejný model jako v západním světě, tedy pomocí cizinců. Cizince jsme začali využívat především jako zdroj levné pracovní síly na méně kvalifikovaná pracovní místa. S příchodem cizinců bylo nutno vyřešit i určité legislativní úpravy. Tyto úpravy se především týkají jejich pobytu, podmínek, za kterých smí pobývat na území České republiky a podmínek pro udělení trvalého pobytu a následně občanství. Hlavní část této právní úpravy je obsažena v zákoně č. 326/1999 Sb. o pobytu cizinců na území České republiky. Po vstupu České republiky do Evropské unie a následném přistoupení do Schengenského prostoru bylo nutné ještě zapracovat do našeho právního řádu směrnice a nařízení Evropské unie. Tak jako občané České republiky jsou povinni dodržovat právní řád naší země, tak tato povinnost přechází i na cizince po vstupu na naše území. Český právní řád jim přiznává určité práva, ale i ukládá určité, zákonem dané povinnosti. Na dodržování těchto povinností především dohlíží stát a to prostřednictvím jím určeným státním orgánem, v rámci výkonu veřejné správy. Jednou z důležitých funkcí veřejné správy je funkce mocenské ochrany. Podstatou funkce mocenské ochrany je poskytnutí ochrany orgány veřejné správy, s cílem zajištění bezproblémového chodu veřejné správy, a zjednání nápravy tam, kde došlo k porušení právních povinností .

Abstract:

The main task of this work is to describe the current practice of administrative authorities in the field of administrative punishment of foreigners. The fact that an alien has a different legal status in the Czech Republic compared with domestic citizens, means that there is a need to legally underpin the way a stranger’s infringement is corrected and punished. Each country regulates the responsibilities of the aliens by itself, and if there is a breach of these obligations, a punishment is imposed. The sanction is imposed in administrative proceedings by the administrative authority. First, I describe the system of administrative punishment in general terms and also its position and inclusion in the legal system of the Czech Republic. I have stated here that administrative criminal law is essentially a separate part of administrative law, while at the same time, one cannot imagine substantive administrative law, administrative law and administrative law process without it. All principles of administrative law are based on the principles of criminal law. Just as in criminal law, a certain responsibility arises when interests protected by the administrative law are violated. This responsibility is connected with an obligation to accept and bear the penalty determined by law. This offense is referred to as an administrative offense. These administrative offenses are described in greater detail, because they are the most frequent types of infringement regulated by administrative law and subsequently are dealt with by the administrative authority in an administrative procedure. I closely analyze the division of administrative offenses from misdemeanours to other administrative offenses, their features and subsequently imposed penalties. The main theme of this work, however, is the administrative expulsion. This is a response to the illegal stay of an alien in the Czech Republic. If we look more closely at administrative law and the sanctions to be imposed, we see that administrative expulsion is not a sanction, but the so-called country’s measures. It is important to note that it is not necessary to prove to the foreigner the culpability of his conduct. If the unlawful act of illegal residence has been properly demonstrated, the administrative expulsion and subsequent prohibition of residence in the Czech Republic follow. The decision of the administrative expulsion must be justified and there must be a possibility for the foreigner to appeal, and thus ensure that the proceedings are carried out according to administrative law.
