Analysis of the Article 7(1) of Regulation No. 1215/2012 on Jurisdiction and Recognition and Enforcement of Judgments in Civil and Commercial Matters

Abstract:

Diplomová práce se zaměřuje na analýzu článku 7 odst. 1 Nařízení Brusel I bis z hlediska tradičního a elektronického obchodování. Cílem práce je ověřit, zda v případě tradičního obchodování mezi podnikateli stále vznikají interpretační potíže při aplikaci předmětného článku a možnost aplikace tradičních výkladových pravidel na spory z elektronických obchodů. Kritériem pro určení soudní příslušnosti je dle článku 7 Nařízení místo plnění, které v některých případech, obzvláště v případech, kdy dochází k plnění v nehmotné podobě, může být obtížně určitelné. Práce nabízí možné interpretace pojmu místo plnění opírající se o odbornou literaturu, judikaturu Soudního dvora Evropské unie a úvahy autorky práce.

Abstract:

The thesis is focused on the analysis of the article 7 (1) of the Brussels I bis Regulation in terms of traditional trading and e-commerce. The aim of the thesis is to determine whether interpretational difficulties still arise in the application of the present article in the case of traditional trading between entrepreneurs and the possibility of applying traditional rules of interpretation to disputes arising from e-commerce. Pursuant to Article 7 of the Regulation, the criterion for determining the jurisdiction is the place of performance, which in some cases, especially in cases where the performance takes place in an intangible form, can be difficult to determine. The thesis presents possible interpretation of the concept of the place of performance based on the scientific literature, case law of the Court of Justice of the European Union and author’s reflections.
