Destructive jurisprudence in tax law

Abstract:

Tato diplomová práce se zabývá judikaturou správních soudů, která zásadním způsobem zasáhla do daňového práva a tím i do stávající rozhodovací praxe orgánů finanční správy. Pozornost je věnována postavení Nejvyššího správního soudu a Ústavního soudu a jejich úloze v zajišťování jednoty a zákonnosti rozhodování, dále pak jejich roli v oblasti sjednocování judikatury. V závěru pak obsahuje rozbor vybraných soudních rozhodnutí a jejich dopad do správní praxe.

Abstract:

The diploma thesis is focused and discussed the jurisprudence of administrative courts which affected the tax law significantly and consequently they influenced the current decisional practice of financial management bodies. Particular attention is given to the position of the Supreme Administrative Court and the Constitutional Court and also to their role in ensuring the unity and regularities of decision making and in the field of unifying jurisprudence. Based on the above mentioned role of destructive jurisprudence in tax law the selected judicial decisions and their impact on the administrative practice are analyzed in the following part of the work.
