Abstract:

ACSOVÁ, Jana: Withholding tax and its legal regulation [bachelor thesis]: Banking Institute/College of Banking, international college in Banská Bystrica.Department of Economy, Pricing, Social Sciences and Law. Supervisior: JUDr. Ing. Lucia Kubincová. Year of Advocacy: 2013. Number of pages: 58. Legislative intentions of the Government are revealed in important areas that present the need to achieve budgetary income plan. Their essential part is created from income tax, therefore the area of taxation belongs to the often changed ones. The aim of the bachelor thesis is to show the realisation of the flexible tax collection policy, using the legal regulation of withholding tax, from the view of the taxable person and the tax payer. The bachelor thesis deals with the development of the income tax law in the period from 1993 to 2013 with the practical application on selected income, especially from businesses with income tax withholding. The first chapter deals with the background of income tax legislation in general, income tax implementation into the Slovak republic tax system and introduction of taxable incomes in the Slovak income tax law. The second chapter links up to the first chapter in the context of withholding tax legislation as the income tax with the special ambit of taxpayers and the special kind of incomes. The third chapter deals with the practical application of income tax withholding in the chosen cases of payments.

Katedra ekonómie, oceňovania, spoločenských viad a práva. Vedúci práce: JUDr. Ing. Lucia Kubincová. Rok obhajoby: 2013. Počet strán: 58. Legislatívne zámery vlády sa premietajú v ťažiskových oblastiach, medzi ktoré s určitosťou patrí aj potreba naplnenia rozpočtovaných príjmov. Ich nevyhnutnou súčasťou sú príjmy dane z príjmov, preto táto oblasť podlieha častým zmenám. Cieľom bakalárskej práce je poukázať na realizáciu zámerov štátnej politiky pri pružnom výbere daní prostredníctvom právnej úpravy dane z príjmov vyberanej zrážkou z pohľadu daňovníka a platiteľa dane. Bakalárska práca sa zaoberá vývojom právnej úpravy dane z príjmov v rokoch 1993 – 2013 s praktickou aplikáciou na vybrané príjmy, najmä podnikateľské, z ktorých sa daň z príjmov vyberá zrážkou. Prvá kapitola je zameraná na všeobecné východiská právnej úpravy dane z príjmov, zavedenie dane z príjmov do daňovej sústavy Slovenskej republiky a uvedenie zdaniteľných príjmov z pohľadu slovenského zákona o dani z príjmov. Druhá kapitola nadväzuje na prvú kapitolu v kontexte právnej úpravy dane z príjmov vyberanej zrážkou, ako dane z príjmov s osobitným okruhom daňovníkov a s osobitným druhom príjmov. Tretia kapitola sa zaoberá praktickou aplikáciou dane z príjmov vyberanej zrážkou na vybraných prípadoch príjmov.
