Mechanisms allowing a Deflection from a Neutral Conflict-rule Method

Abstract:

Hlavním cílem této rigorózní práce je analýza vybraných mechanismů, které umožňují odchýlení od postupu dle neutrální kolizní metody, při určování rozhodného práva v mezinárodním právu soukromém. První část práce se věnuje rozboru tradiční kolizní metody, jako elementární metody mezinárodního práva soukromého, především z hlediska jejího vývoje a funkce. Následující části se zabývají jednotlivými mechanismy, které určitým způsobem modifikují postup dle klasické kolizní metody a výsledkem je odchylné řešení. Pro tuto práci byly zvoleny takové mechanismy umožňující odklon se od neutrální kolizní metody, které kladou důraz na materiální aspekt řešení a berou ohled na hmotněprávní následky. Každý ze zvolených mechanismů je analyzován v obecné rovině a následně také z hlediska přístupu národního mezinárodního práva soukromého a také z hlediska právního řádu EU, spolu s předmětnými ustanoveními legislativní úpravy. Závěrečná část práce poskytuje zhodnocení využití těchto odchylných mechanismů ve srovnání s využitím metody kolizní a shrnutí vývoje těchto institutů ve světle moderního mezinárodního práva soukromého. A samozřejmě jsou zde uvedeny také závěry z této práce vyplývající.

Abstract:

The main aim of this rigorous thesis is to analyze selected mechanisms that allow deflection from the procedure according to the neutral conflict-rule method, in determining applicable law in private international law. The first part is devoted to the analysis of the traditional conflict-rule method, as an elementary method of private international law, especially in terms of its development and function. The following sections deal with individual mechanisms that somehow modify the procedure according to the traditional conflict-rule method and result in a different solution. For this thesis, mechanisms have been chosen that allow deflection from the neutral conflict-rule method, which emphasizes the material aspect of the solution and takes into account the material consequences. Each of the selected mechanisms is analyzed in general terms and subsequently also in terms of the approach of national private international law and also from the point of view of the EU legal order, together with the relevant legislative provisions. The final part of the thesis provides an evaluation of the use of these deviating mechanisms in comparison with the use of the conflict-rule method and a summary of the development of these institutes in the light of modern private international law. And, of course, the conclusions of this work are also presented here.
