A legal regime of a territory in the international law

Abstract:

The development of the international law is closely linked with the emergence and development of each country, with their territorial claims, political, economical, environmental and social interests and needs. This bachelor thesis entitled “The legal regime of the territory in the international law” presents in three chapters a brief, but entire theoretical view on the issue of territorial regime from history to the present, defines the basic concepts and rules pertaining to this issue and is dedicated to the national territory, borders and regimes valid in the border area, as well as international legal arrangement of regime of areas, such as Antarctic, sea and space, which are not under sovereignty of any state. They are referred to specific statuses and international legal arrangements of territorial regimes, which are of particular relevance in terms of their use in research, research activity, use of natural resources and mineral wealth, solving the environmental issues and future prospects of humanity.

Abstract:

Vývoj medzinárodného práva je úzko spätý so vznikom a vývojom jednotlivých štátov, s ich územnými nárokmi, politickými, ekonomickými, enviromentálnymi a spoločenskými záujmami a potrebami. Bakalárska práca s názvom Právny režim územia v medzinárodnom práve predkladá v troch kapitolách stručný, ale celistvý teoretický pohľad na problematiku územných režimov od histórie až po súčasnosť, definuje základné pojmy a pravidlá ktoré sa viažu k tejto problematike a venuje sa štátnemu územiu, hraniciam a režimom platným v hraničnom území, ako aj medzinárodnoprávnej úprave režimu takých priestorov, akými sú Antarktída, morský a kozmický priestor, ktoré nepodliehajú suverenite žiadneho štátu. Na ne sa vzťahujú špecifické statusy a medzinárodné právne úpravy územných režimov, ktoré majú význam najmä z hľadiska ich využitia na výskum, bádateľskú činnosť, využitie prírodných zdrojov a nerastného bohatstva, riešenie otázok životného prostredia a budúcich perspektív ľudstva.
