The injured and attorney in the criminal proceedings

Abstract:

Práce se zabývá problematikou postavení poškozeného v trestním řízení a uplatnění jeho práv a povinností v jeho jednotlivých stádiích. Práce se rozčleňuje na dva větší okruhy. První z nich se dotýká problematiky poškozeného ve stádiích trestního řízení. Jaká práva a povinnosti má poškozený možnost uplatnit, jaké jsou rozdíly mezi poškozeným a obětí trestného činu a kdo a kdy může zastupovat poškozeného v průběhu trestního řízení. Druhý okruh práce se zabývá zmocněncem poškozeného v trestním řízení. V práci je zmíněno postavení a osoba zmocněnce v trestním řízení, koho má zmocněnec možnost zastupovat. Práce se dotýká i problematiky institutu společného zmocněnce. Závěrečná část práce se zabývá úvahami de lege ferenda v problematice poškozeného a jeho postavení v trestním řízení a uplatnění nároku náhrady škody v adhezním řízení a zastupování poškozených osob zmocněncem.

Abstract:

The thesis deals with the issue of the position of the injured party in criminal proceedings and with the application of his rights and obligations in the context of adhesion proceedings in criminal proceedings in individual parts of this thesis. The work is divided into two larger circuits. The first one deals with the problem of the injured person in the stages of the criminal proceedings. What rights and obligations the injured has the opportunity to claim, what are the differences between the victim of the crime and the injured person and who and when can represent the injured person during the criminal proceedings. The second part of the thesis deals with the attorney of the injured person in the criminal proceedings. The thesis mentions the position and the person of the proxy in the criminal proceedings, who the representative is able to represent. The thesis also deals with the issue of the joint mandate institute. The final practical part deals with the question de lege ferenda about the injured party in criminal proceedings.
