Abstract:

Cílem diplomové práce je zhodnocení dopadů zákona č. 198/2009 Sb., o rovném zacházení a o právních prostředcích ochrany před diskriminací (antidiskriminační zákon) na postavení žen na trhu práce a na vývoj ve vnímání diskriminace obyvatelstvem České republiky. Práce odpovídá na otázku, zda je antidiskriminační zákon dostatečný v boji proti diskriminaci na trhu práce. V úvodních kapitolách práce jsou vymezeny pojmy rovnost a diskriminace a definovány druhy diskriminace. Zároveň je podán přehled o právním zakotvení diskriminace v evropském a českém právním řádu. Ve třetí části práce je představena teorie diskriminace Garyho S. Beckera a tato teorie je srovnána s koncepcí a obsahem antidiskriminačního zákona. Výsledkem je zjištění, že neexistuje žádná konformita mezi ekonomickou teorií diskriminace a antidiskriminačním zákonem. Poslední část práce zkoumá dopady antidiskriminačního zákona na postavení žen na trhu práce v oblasti přístupu k zaměstnávání a odměňování. V této části práce je rovněž zkoumán vliv antidiskriminačního zákona na vnímání diskriminace na trhu práce obyvateli České republiky. Pro dosažení cíle diplomové práce jsou zkoumána statistická data a zároveň bylo provedeno vlastní dotazníkové šetření. Bylo zjištěno, že v postavení žen na trhu práce ani ve vývoji vnímání diskriminace nenastala přijetím antidiskriminačního zákona žádná změna, protože zákon sám si klade za cíl pouze implementovat do českého právního řádu příslušné evropské směrnice.

Abstract:

The aim of the thesis is to evaluate the impact of Act no. 198/2009 Coll., on equal treatment and legal means of protection against discrimination (Anti-Discrimination Act) on the status of women in the labor market and progression in the perception of discrimination of Czech population. The thesis responds to the question whether the Anti-Discrimination Act is sufficient to combat discrimination in the labor market. Equality, discrimination and forms of discrimination are defined in the introductory chapters of the thesis. There is also an overview of the legal anchoring of discrimination of European and Czech law. The theory of discrimination of Gary S. Becker is introduced in the third part of the thesis and this theory is compared with the design and content of Anti-Discrimination Act. The result is, that there is no conformity between economic theory of discrimination and Anti-Discrimination Act. The last section examines the impact of Anti-Discrimination Act on the status of women in the labor market in terms of access to employment and remuneration. This part also studies the influence of Anti-Discrimination Act on the perception of discrimination in the labor market of the Czech population. Statistical data are examined and own survey was conducted in order to achieve the main objectives of the thesis. It was founded, that there is no change in position of women in the labor market and in the progression in perception of discrimination of Czech population, because the Act itself aims only to implement relevant European directives into Czech law.
