Europeanisation of Civil Law

Abstract:

Cílem práce je zmapovat oblasti civilního práva a poskytnout tak ucelený pohled na oblasti, ve kterých dochází k europeizaci, zjistit jakým způsobem a v jakém rozsahu se tak děje, podchytit aktuální unifikační tendence na poli civilního práva a zabývat se jejich dopady na právní řád České republiky. První kapitola je věnována europeizaci obecně, tedy vysvětlení pojmu a prostředkům europeizace. Druhá až osmá kapitola se zabývá jednotlivými oblastmi civilního práva, ve kterých k europeizaci dochází, a to ochranou spotřebitele, právem duševního vlastnictví, právem na ochranu osobních údajů, elektronickou komunikací, neziskovými právnickými osobami civilního práva, rodinným právem a civilním procesem. Poslední kapitola je věnována myšlence Evropského kodexu soukromého práva, jenž dostal konkrétní podobu v konceptu DCFR. Práce nastiňuje jak argumenty jeho zastánců, tak jeho odpůrců.

Abstract:

The aim of the diploma thesis is to plot in which spheres of civil law, in which way and in which range the europeanisation is displayed, to catch the actual unification tendences in the field of civil law and to take in consideration the impacts of this affect to the legal order in the Czech republic. The first chapter describes the europeanisation generally, that is to say the explaining of the conception and the means that help by coming of the europeanisation. The second to the eighth chapters are devoted to the separate domains of the civil law, in which the europeanisation occurs: consumer protection, intelectual property, law for the protection of the personal dates, the electronical communication, nonprofit legal persons, the family law and the civil process. The last chapter is engaged in the idea of European civil code, that got the concrete form in the Draft Common Frame of Reference (DCFR). In this work there are taken both the opinions of its defenders and opponents.
