Victims of crime with a focus on particularly vulnerable victims

Abstract:

Tato diplomová práce se zabývá oběťmi trestných činů se zaměřením na oběti zvlášť zranitelné. V počátečních kapitolách se zabývám základními pojmy spojenými s oběťmi a viktimologií obecně a historií pojmu oběti. Dále řeším otázku, zda existují určité znaky, z nichž by bylo možné vypozorovat zvýšené riziko, že se osoba stane obětí. Kapitola čtvrtá obsahuje výčet nejtypičtějších následků viktimizace a kapitola pátá se zabývá rozdílem mezi obětí trestného činu a poškozeným, jak je definován v trestním řádu. V práci neopomíjím ani zákon č. 45/2013 Sb., o obětech trestných činů a pomoc, na kterou mají oběti nárok. Klíčovou kapitolou je kapitola osmá, v níž jsou definovány zvlášť zranitelné oběti a jejich specifická práva. V následujícíh kapitolách je pak nástin některých výzkumů a statistik týkající se obětí a některé organizace zaměřené na pomoc obětem trestných činů. V předposlední kapitole jsou uvedeny procesní úkony, v nichž má oběť určité specifické postavení, je s ní zacházeno zvláštním způsobem nebo má zvláštní práva. V poslední kapitole je obsažena komparatistika české právní úpravy se slovenskou právní úpravou zaměřenou na oběti trestných činů.

Abstract:

This diploma thesis deals with victims of crime with focus on particularly vulnerable victims. In the first chapters I deal with the basic concepts connected with victims and victimicology in general and with the concept of a victim of the crime. Next, I deal the question of whether there are certain signs that could indicate an increased risk someone of becoming a victim. Chapter Four lists the most typical consequences of victimization, and chapter five deals with the difference between the victim of the crime and the injured party in the criminal proceeding.I do not forget the Act No. 45/2013 Coll., On Victims of Crime. The rights of the victims and the assistance they are entitled to are also defined here. The central chapter - Chapter Eight is focused on particularly vulnerable victims, in which I address the question of who is a particularly vulnerable victim. I also describe their rights and the differences between their rights and the rights of "typical" victims of the crime. The following chapters provide an overview of some research and statistics on victims and some organizations aimed at helping victims of crime. In the next chapter I focus on several specifics of criminal proceedings that concern victims of the crimes.In final chapter, I compare the Czech and Slovak legislation concerning the victims.
