Exaction of delinquent tax and its payments

Abstract:

Efektivním způsobem, kterým se jednotlivec podílí na úhradě veřejných potřeb jsou daně a poplatky, které tvoří převážnou část příjmů plynoucích do veřejných rozpočtů. Předmetem diplomové práce je vymáhání a placení daňových nedoplatků, tedy jakým způsobem stát zajišťuje naplnění veřejných peněžních fondů, jaké prostředky a způsoby volí k tomuto cíli, které státní orgány působící v oblasti veřejné správy realizují výkon dobrovolně neuhrazené daňové povinnosti. Stěžejní část práce je zaměřena na právní předpoklady vymáhání, půběh vymáhacího řízení, formy daňové exekuce včetně realizace a způsobu placení daňových nedoplatků. Práce je doplněna právními názory soudů z daňové judikatury. Samotná práce se zabývá vymáháním a placením daňových nedoplatků v užším pojetí pojmu "daň", tj. daň je chápána jako veřejná dávka, která tvoří soustavu daní. Nucený výkon dobrovolně nesplněné povinnosti je vždy zásahem do dlužníkových majetkových práv a jako takový musí být právními normami regulován a dlužníkovi musí být zajištěna dostatečná ochrana jeho práv ve vymáhacím procesu.

Abstract:

Taxes and government imposed fees are the single biggest source of revenues to fill the government budgets. They are an effective conduit by which the individuals share their responsibility for public interests. The diploma work focuses on the exaction of delinquent tax and its payments. It describes how the government ensures the stream of revenues to fund its budgets. What methods does the government use, which steps does it follow. And which government agencies are involved in the actual collection of voluntary unpaid tax obligations in order to ensure proper funding for government to effectively function. The diploma work also focuses on the law requirements, the course of tax collection process, and the forms of tax exaction and their actual realization and also on the man of payment of the delinquent tax itself. The diploma work is supplemented by the official court opinions released on the subject of tax and tax law. The work itself focuses on the exaction of delinquent tax and its payments in the narrow explanation of tax. Forced exaction of voluntarily undelivered obligations is always a direct entry into debtor property rights. Therefore it needs to be regulated by law. It must be the case that all the rights of debtors are fully protected in this process.
