Effect of Essential Expenses on Income Tax Assesment

Abstract:

Bakalářská práce se věnuje problematice tzv. esenciálních výdajů (nákladů) a jejich případnému zohlednění při stanovení daně z příjmů. Stěžejní problematiku bakalářské práce představuje definování podmínek pro aplikaci doktríny esenciálních výdajů (nákladů), které byly vytyčeny judikaturou Nejvyššího správního soudu. Hlavním cílem bakalářské práce je potvrzení nebo vyvrácení hypotézy, že zohledněním esenciálních výdajů (nákladů) skutečně dochází ke správnému zjištění a stanovení daně z příjmů, doplněné v závěru o pozitivní i negativní stránky doktríny esenciálních výdajů (nákladů) a o úvahy a doporučení de lege ferenda, s tím výsledkem, že stanovení esenciálních výdajů (nákladů) ve svém konečném důsledku vytváří toliko diskriminační a nerovné prostředí.

Abstract:

The bachelor thesis deals with the issue of so-called essential costs (expenses) and their possible consideration in the determination of income tax. The key issue of the bachelor thesis is the definition of conditions for the application of the doctrine of essential costs (expenses), which were set out by the case law of the Supreme Administrative Court. The main goal of the thesis is to confirm or dispute the hypothesis that the consideration of essential costs (expenses) does in fact lead to the correct determination and assessment of income tax, supplemented in the conclusion by the positive and negative aspects of the doctrine of essential costs (expenses) and by considerations and recommendations de lege ferenda, with the result that the determination of essential costs (expenses) ultimately creates only a discriminatory and unequal environment.
