History of torture

Abstract:

Už od raných forem státu jsou snahy o vytvoření pravidel společnosti a položení základů právního státu. S tím související i vývoj trestního práva a jeho postihů. Od středověku se nám formuje tzv. právo útrpné neboli tortura, užívaná při výsleších. Přiznání na mučidlech bylo jedním z nejdůležitějších svědectví o vině či nevině jednotlivce. Tortura byla hojně využívána jak církevními tak světskými soudy až do 19. století, kdy bylo mučení zakázáno. Od té doby je nejvyšší hranicí trestu "pouhý" trest smrti, prováděný tou nejhumánnější formou, která se ovšem stát od státu liší. V práci se bude studentka zabývat, vývojem trestného práva a formami mučení, jejich efektivností a způsobem provedení od raných počátků do vzniku moderního právního zřízení.

Abstract:

Since the early forms of the state, efforts have been made to create company rules and lay the foundations of the rule of law. The related development of criminal law and its sanctions. Since the Middle Ages we have been forming the so-called right of torture or torture used in interrogations. The torture recognition was one of the most important testimonies of guilt or innocence of an individual. Torture has been widely used both by church and secular courts until the 19th century when torture was banned. Since then, the upper limit of punishment has been the "mere" death penalty, carried out in the most humane form, but it differs from the state. The student will deal with the development of criminal law and the forms of torture, their effectiveness and the way of their implementation from the early days to the creation of a modern legal system.
