Freedom of Religion and Church Autonomy

Abstract:

Zpracovaná bakalářská práce je rozdělena do pěti oddílů. V první části bakalářské práce se zabývám náboženstvím a vírou z pohledu právního a religionistického. V druhé části pak svobodou náboženského vyznání formou historického exkurzu, který je zaměřený na totalitní režimy. Ve třetí části svobodou náboženského vyznání v právním řádu České republiky. V této kapitole podrobně rozebírám články Listiny základních práv a svobod a mezinárodní smlouvy, které jsou zaměřené na svobodu náboženského vyznání. Ve čtvrté části rozebírám Katolickou církev a základní práva a svobody člověka. Zejména se soustředím na právo na náboženskou svobodu každého člověka, rodičů, dětí, církví, náboženských společností a státu. Poslední část pojednává o autonomii církví a náboženských společností v právním řádu České republiky. Zabývám se zde charakteristikou církví a náboženských společností, právem svobodného vstupu do církve a náboženské společnosti, ale hlavně registrací církví a náboženských společností v I. a II. stupni.

Abstract:

Bachelor thesis is divided into five chapters. The first part of this work deals with religion and faith from the perspective of law and Religious Studies. The second part outlines the freedom of religion in the form of historical excursus, which is aimed at totalitarian regimes. Third part describes the freedom of religion in the Czech law. In this chapter I analyze in detail the articles of the Charter of Fundamental Rights and Freedoms and international treaties which are aimed at freedom of religion. In the fourth part the Catholic Church and the fundamental human rights and freedoms are discussed. This part deals with the right to religious freedom for everyone, parents, children, churches, religious communities and the state. The last part deals with the autonomy of churches and religious societies in the Czech law. The characteristics of churches and religious societies, the right of free entry into the Church and religious society, but especially the registration of churches and religious societies in the first and second level are given here.
