Debt Relief of Natural Person Entrepreneur

Abstract:

Tato práce se zabývá novým institutem oddlužení podnikatele, které je možné po novele InsZ, která nabyla účinnosti 1. 1. 2014. Nejprve vysvětluji podstatu oddlužení podnikatele, uvádím potřebné dokumenty a shrnuji výhody a nevýhody. Poté přecházím k samotnému schválení oddlužení a k následnému životu podnikatele v oddlužení. Druhá část práce je věnována vybraným problémům, které se týkají oddlužení podnikatele. Jedná se o nově zavedené oddlužení manželů, zesplatnění závazku pro účely insolvenčního řízení a vztahu insolvenčního řízení a směnek, ze kterých je podnikatel zavázán. V práci je zmíněna i nejnovější judikatura soudů, která se dané problematiky týká.

Abstract:

This work deals with new institute debt relief entrepreneur that is possible after the amendment Insolvency Act, which came into effect on January 1, 2014. First, I explain the debt relief entrepreneurs, the necessary documents and summarize the advantages and disadvantages. Then I go to approval of debt relief itself and the subsequent life of the entrepreneurs in debt relief. The second part is dedicated to selected problems relating to debt relief businesses. This is a newly launched debt relief husbands, matures liability for insolvency and relation between bankruptcy proceedings and promissory notes, of which the entrepreneur is obliged to make. In the work is mentioned the latest case law, that is related with this topic.
