Abstract:

Předkládaná práce se zabývá občanskoprávní odpovědností za škodu na zdraví ve zdravotnictví, přesněji případy, kdy škoda vzniká na zdraví pacienta, nikoli lékaře. Zvolené téma se na první pohled může jevit příliš zúženým, jde pouze o odpovědnost za škodu na zdraví, a to ještě pokud k ní došlo při poskytování léčebné péče. Přesto, nebo právě proto, jsou spojeny s odpovědností za tuto škodu specifické problémy. Hlavní část předkládané práce vymezuje v obecné rovině předpoklady odpovědnosti se zřetelem ke zkoumané problematice a vlastní povinnosti k náhradě škody, jednotlivým nárokům de lege lata. Funkce odpovědnosti směřují k jedinému cíli, k opětovnému nastolení rovnovážného stavu mezi subjekty poté, co došlo k deliktnímu jednání, které odpovědnost založilo, resp. poté, co nastala událost s níž je povinnost k náhradě škody podle ustanovení zákona spojena. Právní úprava by měla být odrazem této myšlenky. Výsledkem práce je proto závěr, že odpovědnost za škodu na zdraví ve zdravotnictví by měla být koncipována jako odpovědnost za zaviněné porušení právní povinnosti ze strany lékaře, vyjma situací, kdy škoda je způsobena vadou výrobku. Zde výlučně je prostor pro tzv. objektivní odpovědnost tak jak již nyní je právem upravena. Jednotná základní konstrukce odpovědnosti by odstranila prvek právní nejistoty, který pro poškozeného pacienta současná právní úprava skýtá.

Abstract:

The submitted thesis deals with civil liability for damage to health in health services, or rather said with cases, where the damage occurs on health of patient, not the doctor. The selected topic might appear at the first sight overly narrow, it is only about the liability for damage to health, and even only if it occurred when providing a medical care. Despite, or therefore, there are specific problems associated with liability for this damage. The main part of the submitted thesis defines the general requirements of liability with regard to the surveyed issue and the duty to compensate damage itself, particular claims de lege lata. Functions of liability are oriented to a sole target, to restore the state of equilibrium between the parties after the wrongful action that caused the liability, respectively occurrence of the event which is connected to the obligation to compensate the damage in accordance with the statutory provisions. The legal regulation should be a reflection of that idea. Therefore, result of the thesis is a conclusion that the liability for damage to health in health services should be conceived as a liability for an intentional breach of legal obligations by the doctor, except for situations, when the damage is caused by a defective product. There is exclusively a scope for so-called strict liability as it is already regulated by law. The unified basic concept of liability would eliminate an element of legal uncertainty, which is granted by the current legal regulation to the injured patient.
