Abstract:

Tato diplomová práce je věnována problematice překážek v práci na straně zaměstnance. Cílem této práce je seznámit čtenáře s českou právní úpravou překážek v práci na straně zaměstnance. Vznik překážek, jimiž mohou být pracovní neschopnost, svatba, úmrtí, péče o dítě, stěhování a podobně, jsou běžnou součástí života každého jedince, proto je výhodou mít o této problematice přehled. Práce je rozdělena do osmi kapitol. První kapitola se zabývá důležitými pojmy, které jsou podstatné pro pochopení problematiky překážek v práci. Druhá kapitola objasňuje pojem překážky v práci a jejich právní úpravu. Další, třetí kapitola diplomové práce, se zabývá obecně překážkami v práci na straně zaměstnance. Práce klade důraz na dělení překážek v práci na straně zaměstnance, proto se čtvrtá kapitola podrobněji věnuje důležitým osobním překážkám. Následující pátá kapitola se podrobněji věnuje jiným důležitým osobním překážkám. Šestá kapitola seznamuje čtenáře s překážkami v práci z důvodu obecného zájmu. Sedmá kapitola se zabývá vlivem překážek v práci na straně zaměstnance na jiné pracovněprávní instituty, jakož to na pracovní dobu, dovolenou, zkušební dobu a stabilitu pracovního poměru. Poslední, osmá kapitola diplomové práce, obsahuje praktickou část, která spočívá v čerpání dočasné pracovní neschopnosti na konkrétní pobočce společnosti H&M.

Abstract:

This diploma thesis is devoted to the issue of obstacles to work on the part of the employee. The aim of this work is to acquaint the reader with the Czech legal regulation of obstacles to work on the part of the employee. The emergence of obstacles which can be incapacity for work, marriage, death, child care, moving, etc., are a normal parts of every individual's life, so it is an advantage to have an overview of this issue. The thesis paper is divided into eight chapters. The first chapter deals with important terms that are essential for understanding the issue of obstacles at work. The second chapter clarifies the concept of obstacles to work and their legal regulation. The third chapter of the diploma thesis, deals with obstacles to work on the part of the employee in general. The work emphasizes the division of obstacles at work on the part of the employee, therefore the fourth chapter deals in more details with important personal obstacles. The following fifth chapter goes into more details about other important personal obstacles. The sixth chapter acquaints the reader with obstacles in work due to general interest. The seventh chapter deals with the impact of obstacles to work on the part of the employee on other labor law institutes, as well as on working hours, holidays, probationary periods and stability of the employment relationship. The last, eighth chapter of the diploma thesis contains a practical part, which consists of drawing temporary incapacity for work at a specific branch of the H&M company.
