Critical Analysis of Additional Protocol to the Convention on Cybercrime Concerning the Criminalisation of Acts of a Racist and Xenophobic Nature Committed Through Computer Systems

Abstract:

Předmětem práce je kritický rozbor Dodatkového protokolu k Úmluvě o počítačové kriminalitě týkající se kriminalizace činů rasistické a xenofobní povahy spáchaných prostřednictvím počítačových systémů. Práce zkoumá vhodnost přijaté úpravy Protokolu, problematické body Protokolu i mimo něj (např. ústavní ochrana nenávistných projevů v USA a problematika Internetu a jurisdikce) a koncepční změny či alternativní nástroje, které by umožnily další pokrok v boji s nesnášenlivostní internetovou kriminalitou. Analyzovány jsou texty dokumentů, závěry z odborných publikací i relevantní judikatura.

Abstract:

The subject of this thesis is the critical analysis of the Additional Protocol to the Convention on Cybercrime, concerning the criminalisation of acts of a racist and xenophobic nature committed through computer systems. This thesis assesses the provisions of the Protocol, the key issues arising both from the Protocol and the external situation (such as the constitutional protection of hate speech in the US and the problems of jurisdiction over the Internet), and policy changes or alternative measures offering an opportunity to advance further the fight against the racist and xenophobic crimes on the Internet. This thesis analyses legal documents, journal articles, as well as relevant court decisions.
