The municipality and the principle of public administration publicity

Abstract:

Tato diplomová práce se zabývá problematikou principu publicity veřejné správy se zaměřením na obecní samosprávu. Zabývá se zejména charakteristikou povinného a dobrovolného zveřejňování informací obcemi, jakož i principů dobré správy obecně. Jejím cílem je zejména popsat a charakterizovat rozsah a mantinely zákonného nebo technického charakteru, na která obce při zveřejňování informací narážejí. V první části diplomové práce je objasněn pojem principů dobré správy (v evropském kontextu), jejich právní a jiný základ a současné zakotvení v současné právní úpravě. To u obcí, jakožto povinných subjektů, zahrnuje zejména poskytování informací podle zákona č.106/1999 Sb., o svobodném přístupu k informacím a dále podle zákona č. 128/2000 Sb., o obcích. V závěru diplomové práce jsou popsány možnosti dobrovolného zveřejňování informací obcemi tak, aby byly naplněny nejen povinnosti podle zákona, ale zejména moderní koncepce otevřeného úřadu 21. století, který dobrovolně a v maximálním rozsahu poskytuje informace o své činnosti.

Abstract:

This thesis deals with the issue of the principle of publicity of public administration with a focus on municipal self-government. In particular, it deals with the characteristics of mandatory and voluntary disclosure of information by municipalities as well as the principles of good governance in general. In particular, it aims to describe and characterize the scope and limits of legal or technical nature that municipalities encounter when publishing information. The first part of the thesis explains the concept of good governance principles (in the European context), their legal and other basis and their current anchoring in the current legislation. For municipalities, as obliged subjects, this includes in particular the provision of information according to Act No. 106/1999 Coll., on free access to information and Act No. 128/2000 Coll., on municipalities. In the conclusion of the thesis, the possibilities of voluntary disclosure of information by municipalities are described in order to fulfil not only the obligations under the law, but especially the modern concept of an open authority of the 21st century, which voluntarily and to the maximum extent provides information about its activities.
