Abstract:

Disertační práce se zabývá specifickou problematikou správního práva - problematikou postavení, působnosti a pravomoci dotčených orgánů. Autor pojímá tuto problematiku z širšího pohledu zajištění ochrany veřejného zájmu v řízeních vedených podle zvláštních právních předpisů. Disertační práce vychází z platných právních předpisů, z dostupné odborné literatury a judikatury, zejména správních soudů. První a druhou kapitolu disertační práce tvoří obsah práce a seznam v práci používaných zkratek. V úvodu práce (třetí kapitola) autor popisuje ústavní základy problematiky, dosavadní stav odborného poznání v této oblasti a dále představuje hypotézy, z nichž v této práci vychází. Prvou hypotézou je, že současná právní úprava postavení, pravomoci a působnosti dotčených orgánů představuje dobré východisko pro účinnou ochranu jednotlivých veřejných zájmů jimi hájených a s tím související předpoklady pro ochranu oprávněných zájmů všech účastníků řízení. Druhou hypotézou je, že je nutné a žádoucí, aby bylo specificky upraveno postavení dotčených orgánů, popřípadě že existence postavení správního orgánu jako dotčeného orgánu je potřebná. Čtvrtá kapitola pojednává o záměru disertační práce. Základním cílem disertační práce je jednak samotné provedení analýzy problematiky postavení dotčených orgánů, se zaměřením na specifika jejich postavení ve vztahu k obecně chápanému pojmu správní orgán, a to současně ve třech rovinách přestavovaných platnou právní úpravou, odbornými názory ke zkoumaným otázkám, včetně názorů vyjádřených v judikatuře správních soudů, poznatky z veřejnosprávní praxe. Obě hypotézy jsou vystavěny na předpokladu - dílčí hypotéze, že dotčený orgán je obecně správním orgánem a do postavení dotčeného orgánu se dostává v konkrétních právem vymezených situacích a současně, že toto jeho postavení je natolik specifické, že s ohledem na celou řadu veřejných zájmů je odůvodněno, aby dotčené orgány do správních řízení k ochraně těchto veřejných zájmů vstupovaly. Pátá, šestá a sedmá kapitola tvoří těžiště disertační práce. Kapitola pátá pojednává o dotčených orgánech, vymezuje pojem dotčeného orgánu, jeho působnost a pravomoc. Dále se kapitola zabývá procesním postavením dotčených orgánů včetně jejich věcné a místní příslušnosti a správním dozorem jako správní činností, kterou některé dotčené orgány vykonávají. Kapitola šestá pojednává o úkonech dotčených orgánů. Specifikuje druhy správních aktů, které dotčené orgány vydávají. Zaměřuje se a podrobně pojednává o závazných stanoviscích jako o zvláštním druhu podkladových správních úkonů. Vymezuje pojem závazného stanoviska, jeho náležitosti a právní účinky, pojednává o řízení, v němž se závazné stanovisko vydává. V rámci pojednání o obsahu závazných stanovisek se specificky zabývá podmínkami závazných stanovisek. Dále kapitola obsahuje pojednání o zvláštnostech koordinovaného závazného stanoviska a řeší též přezkum závazných stanovisek. Ve svém závěru pojednává o jiných úkonech, které dotčené orgány vydávají. Sedmá kapitola se zabývá problematikou ochrany veřejného zdraví jako důležitého veřejného zájmu a pojednává o orgánech ochrany veřejného zdraví jako dotčených orgánech. Kapitola pojednává o ochraně veřejného zdraví v jednotlivých řízeních a postupech podle stavebního zákona, dále v postupech podle dalších zvláštních zákonů a konečně se zabývá některými zvláštními řízeními, v nichž orgán ochrany veřejného zdraví vystupuje jako dotčený orgán. í a posuzování zdravotní způsobilosti k práci leteckého personálu. Součástí je též exkurs k povaze úkonů vydávaných v souvislosti s posuzování zdravotního stavu, který slouží k úplnému vysvětlení celé problematiky. Konečně je v kapitole popsáno řízení o vydání opatření obecné povahy ke zřízení ochranného hlukového pásma. Kapitola osmá se zabývá základním srovnáním vybraných právních úprav z pohledu, jakým je v nich opravená spolupráce správních orgánů za účelem ochrany veřejného zájmu. K porovnání jsou vybrány právní řády Slovenska, Rakouska, Maďarska a Španělska. Cílem této kapitoly je jednak popsat způsob ochrany veřejného zájmu a jednak srovnat tyto zahraniční úpravy s právní úpravou českou. Závěry z tohoto srovnání jsou využity rovněž v rámci doporučení pro změny právní úpravy. Kapitola devátá shrnuje závěry, k nimž autor v této disertační práci dospěl a závěry ve vztahu hypotézám postulovaným v úvodu disertační práce. Kapitola desátá představuje resumé v anglickém jazyce a kapitola jedenáctá je souhrnem použité literatury a pramenů.

Abstract:

This dissertation deals with the specific topic of administrative law - the issue of the position, scope of powers and jurisdiction of Involved Authorities. The author conceives this issue from a wider perspective of protection of public interests in proceedings conducted by special legislation. This dissertation is based on legislation in force, the available literature as well as on case law of administrative courts. The first and second chapter contain Content and List of Abbreviations. In the third chapter - Introduction, the author describes the constitutional basis of the topic, the current state of professional knowledge in this field and presents hypotheses on which this dissertation is based. The first hypothesis presumes that the current legislation on position, powers and responsibilities of Involved Authorities is primarily an appropriate starting point for the effective protection of relevant public interests, which these authorities shall defend and secondarily creates space for the protection of legitimate interests and expectations of all parties. The second hypothesis presumes that it is necessary and desirable to have a specific regulations focusing on the position of Involved Authorities in the legislation as well as that the existence of the special position of administrative authorities as Involved Authorities is necessary. The fourth chapter discusses the purpose of the dissertation. The main aim of the dissertation is firstly to analyse the issue of the position of Involved Authorities, focusing on specifics of their position in relation to the general concept of administrative bodies, simultaneously at three levels which are: legislation in force, professional opinions on the issues being examined, including the views expressed in the case law of administrative courts and relevant information from public administration. Both hypotheses are based on the presumption - the sub hypothesis that the involved authority is the administrative body in general and firstly in the position of the Involved Authority is only in specific situations defined by law. Secondly this position is so specific that, having regard to a range of public interests, it is justified to require Involved Authorities to enter into the administrative proceedings to protect the relevant public interests. The fifth, sixth and seventh chapters are the core of the dissertation. The fifth chapter discusses the position, scope of powers and jurisdiction of Involved Authorities. The chapter deals with the procedural position of Involved Authorities, including their procedural competence and jurisdiction as well as administrative supervision as an administrative activity, which some Involved Authorities perform. The sixth chapter deals with the administrative acts of Involved Authorities. It specifies the types of administrative acts issued by Involved Authorities. It focuses and discusses in detail about Binding Opinions as special kinds of underlying administrative acts. It defines the term of a Binding Opinion, its requirements and legal effects, discusses the procedure in which the Binding Opinions are issued. Within the discussion about the content of Binding Opinions specifically follows up their conditions. The chapter further deals with the specialties of Co-ordinated Binding Opinion and solves also a review procedure of Binding Opinions. At the end of the chapter information about other administrative acts issued by Involved Authorities are given. The seventh chapter deals with the topic of public health protection as an important public interest and deals with Public Health Authorities as Involved Authorities. This chapter deals with public health protection in varied administrative proceedings and procedure under the Building Act 183/2006, as well as in the procedures under other specific laws and lastly deals with some specific proceedings in which Public Health Authorities acts as Involved Authorities. rocedures for occupational disease recognition and Medical assessment of the health eligibility of aviation personnel. It also includes a study of the legal characteristics of medical certificate issued in connection with health assessments, which serves to complete explanation of the topic. Finally, the chapter describes the procedure, in which Measures of General Nature on noise protective zone are issued. The eighth chapter deals with the basic comparison of four selected foreign legal systems from the perspective of how administrative cooperation is regulated in them in order to protect of public interest. The legal systems of the Slovak Republic, Hungary, the Republic of Austria and the Kingdom of Spain were chosen. The aim of this chapter is firstly to describe a method of legal regulation of protection of public interests and secondly to compare these foreign regulation with Czech legal approach. Conclusions of this comparison are also used for recommendations for appropriate changes in legislation. The ninth chapter summarizes conclusions reached in the dissertation including conclusions in relation to hypotheses postulated in the Introduction. The tenth chapter presents an English Summary and the eleventh chapter is a Bibliography of the literature and sources used in the dissertation.
