Transferability of an Individual's Fundamental Rights to a Group of Individuals in Theory and Practice

Abstract:

Říká se, že lidé jsou obdařeni určitými základními či přirozenými právy. Tato práva jsou však často přiznávána i skupinám. Z jakého důvodu? Za jakých okolností mohou být skupiny nositeli základních práv přisuzovaných mezinárodními smlouvami, regionálními úmluvami či národními ústavami toliko jednotlivcům? Tyto otázky dosud nebyly důkladně prozkoumány, a proto se na ně tato práce snaží nalézt odpovědi za pomoci analýzy relevantní odborné literatury a judikatury Výboru Organizace spojených národů pro lidská práva a Výboru pro hospodářská, sociální a kulturní práva; Evropského soudu pro lidská práva; a Ústavního soudu České republiky. Jsou identifikovány tři základní přístupy – první považuje koncepci základních práv jako takovou za politický výmysl nebo pouhou historickou nahodilost; druhý uznává existenci základních práv jednotlivců, ale odmítá, že by základní práva měla náležet i skupinám; a třetí, implicitně zastávaný všemi vybranými tělesy, uznává základní práva skupin a jejich existenci odůvodňuje buď na základě kolektivního vysvětlení zaměřeného na jednotlivce, nebo na základě vysvětlení korporátního zaměřeného na skupinu. Jelikož žádný z těchto postojů, zdá se, není pro účely včlenění konceptu základních práv skupin do univerzálního normativního systému dostatečně přesvědčivý, je navržen pohled zcela nový. Tento pohled vnímá jako nejvyšší hodnotu existenci schopnou reflektovat sebe a své okolí a tedy schopnou tvořit smysl a význam. Tato existence má být chráněna skrze ochranu jednotlivců, kteří jsou schopni reflexivního myšlení, a skupin, které umožňují jednotlivcům jejich myšlenky sdílet a transformovat.

Abstract:

Humans are said to be endowed with certain fundamental or natural rights. Fundamental rights are, however, often conferred also to groups. On which grounds? Under which circumstances can groups be bearers of the fundamental rights endowed by international treaties, regional conventions and domestic constitutions to individuals? These questions have so far never been thoroughly explored and thus the thesis strives to answer them with the help of the analysis of relevant academic literature and case-law of the United Nations Human Rights Committee and the Committee on Economic, Social and Cultural Rights; the European Court of Human Rights and the Czech Constitutional Court. Three attitudes towards group fundamental rights are deduced – the first one regards the whole fundamental rights concept as a political fabrication or a mere historical coincidence; the second one acknowledges individual fundamental rights but refuses that also groups should be endowed with them; and the third one, implicitly advocated by all the selected bodies, recognizes group fundamental rights and justifies their existence either on a collective, individual-centered or on a corporate, group-centered grounds. As none of these attitudes seems, for the purposes of integrating the group fundamental rights concept into the universal normative system, convincing, a new view on group fundamental rights is proposed. This view perceives the existence capable of reflecting itself and the outside world and of creating the meaning to be of the highest value which is to be protected through the protection of individuals capable of reflexive thinking and of groups enabling the sharing and transformation of those thoughts.
