Legal Aspects of the Search in the File in the Trade Law

Abstract:

Živnostenské podnikání představuje nejrozšířenější formu podnikání. V současné době existuje mnoho publikací a prací, které se živnostenským podnikáním a jeho právní úpravou jako celkem zabývají, ovšem bez hlubšího důrazu na jeho jednotlivé aspekty. Zejména živnostenská kontrola bývá často opomíjeným, či jen povrchně řešeným tématem, a to i přes skutečnost, že může v mnoha případech výrazně ovlivnit podnikatelské subjekty, jejich práva a s tím i samotný výkon jejich podnikatelské činnosti. Ve své práci se proto zaměřuji právě na tuto součást živnostenského práva. Úkolem práce je seznámit čtenáře s problematikou kontroly na úseku živnostenské správy. Popsat procesní problematiku živnostenské kontroly, se zaměřením na konkrétní problémy při jejím výkonu a návrh možných řešení či postupů pro jejich odstranění, či minimalizaci. Téma práce bylo zvoleno s ohledem na mou praxi na pozici referenta kontroly živnostenského úřadu obce s rozšířenou působností. Práce tak nevychází pouze z analýzy současné právní úpravy živnostenského podnikání, ale zaměřuje se i na analyzování konkrétních případů z praxe. Dále využívá metody komparace se zahraničními právními úpravami. V úvodu této práce je vymezen pojem živnostenského práva a poskytnut přehled příslušných právních předpisů. Následuje vymezení pojmu kontroly jako takové, charakteristika základních principů živnostenské kontroly a vymezení a popis základního právního rámce pro její výkon. Jsou uvedeny právní předpisy, ve kterých je kontrolní činnost obsažena a přehled orgánů, které se kontrolní činností zabývají, jejich působnost a pravomoci. Dále se práce věnuje analýze práv a povinností jak kontrolujících, tak i kontrolovaných subjektů a procesu ukládání sankcí za porušení právních povinností. Tato část je zaměřena i na konkrétní problémy, se kterými se můžeme při výkonu živnostenské kontroly v praxi setkat. Vzhledem k tomu, že při rozhodování o právech a povinnostech podnikatelských subjektů, případně při ukládání sankcí za spáchání správního deliktu je postupováno podle správního řádu, je poslední část věnována právě této oblasti. V závěru práce došlo k celkovému zhodnocení a shrnutí platné právní úpravy, včetně úvah o možném řešení problému a předložení návrhů de lege ferenda.

Abstract:

The purpose of this work is to introduce the reader to the issue of control in the division of trade office. Further it has been described procedural issue of control of enterprisers by trade office with focusing on concrete propositions while realizing the control as well as proposal of possible solutions or procedures for the minimization or elimination of those propositions. There has been used analysis of legal enactment in the thesis, that are regulating duty of undertakers running a business within the trading law and legal enactments. This legal instrument is governing the execution of the state control or execution of observance supervision of the statutory duties determined by trading law. Seeing that trading of undertakers is quite easily accessible for citizens of the Czech nation, with low demands on eligibility, it represents the most widespread form of trading in the Czech Republic at the present time. Therefore is the trading justice regulating probably the biggest number of domestic trading activities. In the opening part of my bachelor thesis I dwell on delimitation trading justice it self and the legal regulations determining trading of undertakers. In following part I specify concept of control in generous, its subjects and goals. Then I continue with acquaintance with the subject of trading control itself. It means the execution of administrative control pursuit within undertakers trading, in face of undertakers, eventually in face of all the other persons whose activity fall within range of trading law, e.g. cases of unauthorized trading by physical entity with no trade licence (they are not undertakers). I define worth, significance, purpose and goals of trading control – namely effort for customer preservation against negative impact related with undertaker trading but also pursuit to restrict the legalization returns coming from criminal activities (control of places of business with second-hand goods) or control of trading of foreigners within the context of foreigners migration etc. In connection with trading control I mention the legal regulations that are the execution of trading control based on (trading law and law of state control). In the case of state control determining procedural aspect of control I advert to especially its problematic enactments – e.g. obligation to afford a co-operation with control authority, related principle of ban on self-incrimination etc. Pivotal part of my work represents the analysis of statutory duties of undertakers implicit in the trading law with focusing on such enactments that seem to be the most disputable while trading control executing in practice. On this part is signing on with definition and analysis of sanctions claimed by control authority in the case of infraction these regulations (pecuniary sanction, interruption or even cancellation of trading licence). In fine of my work I aim for general review and résumé of valid legal regulations for trading control. I evaluate my knowledge with consideration of possible solution this issue and I submit my proposals de lege ferenda.
