Termination of the verification in criminal proceedings

Abstract:

Ve své diplomové práci řeším problematiku ukončení stádia prověřování v trestním řízení. Vhledem k tomu, že k pochopení stádia prověřování je zapotřebí pochopit i další aspekty a souvislosti trestního řízení, rozvádím zde základní pojmy a účel trestního řízení jako celku i jeho jednotlivých stádií. V práci vytyčuji zásady trestního řízení, které se uplatňují zejména ve stádiu prověřování, tedy v trestním řízení před zahájením trestního stíhání. Dále v práci charakterizuji stádium prověřování v souvislosti s postupy orgánů činných v trestním řízení. Zaměřil jsem se na základní postupy policejních orgánů, kterými jsou požadování vysvětlení od státních orgánů, právnických i fyzických osob, použití operativně pátracích prostředků jako je předstíraný převod, sledování osob a věcí a použití agenta a další činnosti policejních orgánů, kterými jsou provedení neodkladných a neopakovatelných úkonů a vyžadování odposlechu a záznamu o uskutečněném telekomunikačním provozu.

Abstract:

In my diploma thesis I deal with the issue of termination of the examination stage in criminal proceedings. For better understanding the examination stage it is neccessary to know other aspects and contexts of criminal proceedings. That is why I also divide the basic principles and purpose of the criminal proceedings as a whole and its individual stages. In my thesis I set out the principles of criminal proceedings, which are applied especially at the examination stage or in criminal proceedings before the criminal prosecution. I also describe the stage of the examinning in connection with the police procedures involved in criminal proceedings. I have focused on the basic procedures of the police authorities, which are to request explanations from state authorities, legal and natural persons, use of operational search facilities such as fake transfers, person and subject monitoring and use of the agent, and other police activities that are urgent and unrepeatable actions and requiring wiretapping and recording of the telecommunication traffic. In the diploma thesis I describe the individual ways and legal provisions connected with the handling the case at the examination stage. In the diploma thesis I deal with the possible recodification of the Criminal Procedure Act focusing on the legal provisions concerning the end of the screening stage. I also compare the legal status of termination of the screening stage in the Czech Republic and Slovakia. The aim of the thesis is to answer the question whether the recodification of the Criminal Procedure Act related to the termination of the examination stage is necessary.
