Comparison legislative regulation of adoptions between Czech republic and Slovak republic

Abstract:

Diplomová práce se zabývá porovnáním dvou právních úprav institutu osvojení. Cílem práce je zkoumat podobnost a rozdílnost právních úprav v ČR a SR, současně se zaměřit na pojmové znaky osvojení. Práce je rozdělena na 8 částí. V úvodních částech práce jsou vymezeny pojmy samotného osvojení, definice osvojení s důrazem na odlišnosti porovnávaných právních úprav. V dalších částech práce se rozebírají zákonné předpoklady, podmínky osvojení včetně osob, které vstupují do samotného procesu osvojení. Těmito osobami jsou osvojitel (osvojitelé) a osvojenec. Obě tyto osoby musí projevit souhlas s osvojením. Samotné projevení ohlasu tvoří samostatnou kapitolu práce. Poslední části práce jsou věnovány důsledkům, které při osvojení nastávají, dohledu nad osvojením a možnosti zrušení osvojení. Všechny výše zmíněné kapitoly práce obsahují samotné srovnání obou platných právních řádů v České republice a ve Slovenské republice.

Abstract:

The thesis deals with comparing the two systems of the institute of adoption. The aim of this work is to examine the similarities and differences between the law in the Czech Republic and Slovak republic, at the same time to focus on the conceptual features of adoption. The work is divided into 8 parts. In the introduction part of the thesis, I define the term of adoption itself, the definition of adoption with an emphasis on the differences between the compared legislation. In other parts, this thesis discusses the legal prerequisites, conditions of adoption including the persons entering into the process of adoption. These people are the adopter (adopters) and the adoptee. Both must express approval with the adoption. The agreement itself is discussed in a separate charter of this work. The last part of the thesis is dedicated to the consequences that occur around the adoption, to the supervision above the adoption, and the possibility of revocation of adoption. All the above mentioned parts of this thesis contain the actual comparison of the two existing law systems in the Czech Republic and the Slovak Republic.
