Evidence Procedure in Criminal Proces in Light of Theory of Fruits of Poisoned Tree

Abstract:

Diplomová práce se věnuje dokazování v trestním řízení ve světle teorie plodů z otráveného stromu. První kapitola pojednává o dokazování jako celku s důrazem na přípravné řízení. Další část textu se věnuje teoretickému výkladu teorie plodů z otráveného stromu, který je dále rozebrán v krátkém historickém exkurzu o jejím vývoji v USA a Německu. Třetí a hlavní část práce se zabývá praktickým dopadem zkoumané teorie na trestní řízení. Nejprve je v ni rozebírána právní úprava této doktríny v ČR a následně aplikace této doktríny na jednotlivé důkazní prostředky v trestním řízení. Cílem práce je podat komplexní a reálný pohled na to, jakým způsobem se orgány činné v trestním řízení staví k teorii plodů z otráveného stromu. V závěru práce jsou uvedeny úvahy de lege ferenda k dané problematice.

Abstract:

The master thesis is concerned with an argumentation in a criminal proceeding in the light of the fruit of the poisonous tree doctrine. The first chapter deals with the argumentation as a whole with an emphasis on a preparatory procedure. Next part of the text discusses a theoretical explanation of the fruit of the poisonous tree doctrine, which is examined further in a short historical discursion about its development in the USA and Germany. The third and the most important part of the thesis discusses the practical impact of the analysed doctrine on a particular type of evidence in a criminal proceeding. At first, the legislation of this doctrine in the Czech republic is examined, than the application of this doctrine in a criminal proceeding is analysed. The aim of this thesis is to introduce a complex and real perspective on what is the standpoint of enforcement authorities in criminal proceedings toward the fruit of the poisonous tree doctrine. In the conclusion there are listed ideas de lege ferenda on the issue.
