The powers of trade union regarding to constitutional court´s judgement number 116/2008.

Abstract:

Diplomová práce se zabývá především nálezem Ústavního soudu č. 116/2008 Sb. a jeho dopadem na odborové organizace a to zejména v oblasti kontrolních pravomocí a ovlivnění stavu bezpečnosti a ochrany zdraví při práci (BOZP). V rámci jedné z kapitol jsou analyzovány příčiny ustavní stížnosti, rozbor návrhu poslanců a senátorů na zrušení některých ustanovení zákona č. 262/2006 Sb., zákoníku práce, stanoviska účastníků řízení a dalších příslušných orgánů, ústavněprávní argumentace a rozhodnutí Ústavního soudu. Dále jsou v práci rozpracovány dopady Nálezu na problematiku smluvní volnosti, na vztah zákoníku práce k občanskému zákoníku a na další oblasti pracovního práva (vnitřní předpis, rovnost zástupců zaměstnanců) v souvislosti se zrušením jedenácti ustanovení původního zákoníku práce. Postavení a účast zaměstnanců v pracovněprávních vztazích, bezpečnost práce a ochrana zdraví při práci a kolektivní vyjednávání jsou nezanedbatelnými částmi této problematiky, tedy i této diplomové práce.

Abstract:

The dissertation is being concerned above all with the constitutional court´s judgement number 116/2008 and its impact on trade unions, mainly in the area of checking competences and having an influence on the status of safety and health protection during working (BOZP). In the frame of one of chapters there are analyzed the causes of a constitutional complaint, the analysis of the Parliament and Senate members suggestion to cancel some assignments of law no.262/2006, the labour code, attitudes of procedure participants and other relevant bodies, constitutional-law argumentation and the Constitutional Court decision. In my work there are also analyzed Findings of law impacts on contracting equality problems, on the labour code relation to the civil code and on other areas of labour rights (an internal regulation, employée representatives equality) in connection with cancelling eleven regulations of the original labour code. The employée status and participation in labour-law relations, work safety and health protection within work and collective negotiations aren?t negligible issues of these problems, consequently this diploma work.
