Civil trial in the period of 1918 - 1939 in our country

Abstract:

Tématem mojí diplomové práce je civilní proces v meziválečném období v ČSR. Práce je rozdělena na pět základních kapitol, kdy první se zabývá vývojem civilního soudnictví v období první Československé republiky a charakteristikou obecného soudnictví stejně jako charakteristikou jednotlivých specializovaných soudů.Druhou část tvoří organizace civilního soudnictví v první Československé republice, kde jsou vymezeny jednotlivé stupně soudní organizace od nejvyšší instance přes nižší stupně až po základní organizační jednotku kterou byly okresní soudy.Další část je věnována soudnictví rozhodčímu, které patří do skupiny tzv. alternativního řešení sporů a počátky právní úpravy mezinárodní arbitráže.Následující kapitola je zaměřena na personální obsazení soudů tedy osoby soudní.Poslední kapitola je stručně věnována právu konkurznímu jehož právní úprava vycházela z rakouského konkurzního řádu který se spolu s uherským konkurzním řádem staly součástí československého

Abstract:

The sense of this diploma work is to describe the System of courts and Civil trial in the period of 1918 - 1939 in our country and to make the comparison of its sense for present legal regulation of civil proceedings and the judicial system. The task of my work was to point out the sense of legal regulation of civil trial and judicial system in the first Czechoslovak Republic. The first Czechoslovak Republic took over - within the reception of the Austrian and Hungarian legal rules and Austrian and Hungarian administration - nearly complete judicial system and gradually improved it. My work is divided into 5 chapters. First chapter refers to the development of common judicial system as well as to the characteristic of specialized courts. The second chapter is focusing on the organization of Civil trial in the period of 1918 - 1939 in our country. In this chapter there are defined all levels of the judicial system. The third part talks about arbitration judicial system which falls into the group called alternative dispute resolution. Following chapter refers to personal occupancy of courts. In the last chapter I am focusing on bankruptcy law which came out of the Austrian bankruptcy regulations which together with the Hungarian regulations became part of the Czechoslovak Legal Code.
