Import and export in terms of taxes and duties

Abstract:

Práce na téma dovoz a vývoz z pohledu daní a cel se zabývá zahraničním obchodem Evropské unie (dále jen EU) ve vztahu k třetím zemím. Vstup České republiky do EU k 1.5.2004 přinesl podstatné změny jak v oblasti daňové, tak celní. Z daňového hlediska se za „dovoz a vývoz“ považuje pouze obchod subjektů členských států EU se subjekty ze třetích zemí. Práce se proto věnuje novým aspektům vyplývajícím z obchodních vztahů EU a třetích zemí. Cílem práce je podat základní přehled o dané problematice v oblasti nepřímých daní včetně cel za pomoci příslušných předpisů a v závěru práce aplikovat tato zjištění na konkrétním příkladu českého podniku. Úvodní část je zaměřena na společnou obchodní politiku EU a nástroje, kterými se snaží ovlivňovat ekonomické vztahy se třetími zeměmi. Dále se práce věnuje legislativnímu rámci v oblasti daně z přidané hodnoty (dále jen DPH), spotřebních daní (dále jen SpD) a celnímu řízení při dovozu a vývozu zboží do/ze třetích zemí. Je zde popsán systém vyměřování a vybírání daní správcem daně, tj. od vzniku daňové povinnosti až po osvobození od DPH a SpD a výběru cla celní správou EU. V práci byla použita metoda analýzy odborné literatury a legislativy a metoda komparace zjištěných dat.

Abstract:

Thesis focused on imports and exports in terms of taxes and duties is engaged in foreign trade of the European Union (hereinafter referred to as EU) and third countries. Czech Republic's accession to the EU on 1 May 2004 has brought significant changes in the tax and customs area. From a tax perspective, “imports and exports” considers only trade between entities Member States of the EU and third countries entities. The thesis is therefore devoted to new aspects arising from trade relations between the EU and third countries. The aim of this thesis is to give a basic overview of the subject in the area of indirect taxes including customs duties and subsequently apply the relevant provisions and conclusion of these findings into practice of the Czech company. The first part is focused on the EU common trade policy and tools that try to influence economic relations with third countries. Furthermore on a legislative framework in the field of value added tax (hereinafter referred to as VAT), excise duties and customs import and export goods to/from third countries. The system for levying and collecting taxes has been described, i.e. VAT becomes chargeable to the exemption from VAT, excise tax and customs duties collection by Customs EU. The method of analysis of scientific literature and Legislation method and comparison of collected data in different subsections has been used.
