Restrictions of real estate owners within act on nature and landscape protection

Abstract:

Bakalářská práce pojednává o omezeních vlastníků nemovitostí vyplývajících ze zákona o ochraně přírody a krajiny k právnímu stavu na konci roku 2010. V úvodních kapitolách práce je pojednáno o obecných právních aspektech omezení vlastnického práva k nemovitosti. Hlavní pozornost je v práci zaměřena na omezení vlastníků nemovitostí, případně jiných uživatelů, vyplývající z obecné a zvláštní ochrany přírody a krajiny jak územní tak druhové. Práce se zabývá i omezením plynoucím z Natury 2000, kompenzacemi vlastníka nemovitosti v režimu zákona o ochraně přírody a krajiny a případnými sankcemi za nedodržení zákona. Práce je doplněna judikaturou a odbornými články k dané problematice. V závěru je zhodnocena platná právní úprava ochrany přírody a krajiny a její dopad na vlastníky nemovitostí.

Abstract:

This bachelor paper deals with the restrictions of property owners in accordance with the Wildlife and Countryside Protection Bill as of the end of 2010. The initial chapters deal with the general legal aspects concerning restrictions to property ownership rights resulting from general and special protection of land and species. The paper also deals with restrictions resulting from the Natura 2000 programme, property ownership compensation in accordance with the Wildlife and Countryside Protection Bill and eventual sanctions in the event of contraventions of the aforementioned bill. The paper includes judicature and professional articles concerning the given topic. The final chapter contains an assessment of current legislation concerning wildlife and countryside protection and its impact on property ownership rights.
