Sanctoin for criminal conspiracy according to the penal code

Abstract:

V této bakalářské práci je vymezena definice zločinného spolčení, vysvětlen rozdíl mezi zločinným spolčením a organizovanou skupinou. Je zde pojednáno o vlastním postihu organizované trestné činnosti se zaměřením zejména na § 43 a 44, § 163a až 163c TZ. Je zde odpověď na otázku, jak trestat pachatele, kteří jsou současně pachateli trestného činu spáchaného ve prospěch zločinného spolčení a současně nebezpečnými recidivisty. Je zde vysvětleno jak se řeší problém organizovaného zločinu na Evropské úrovni a jak se Evropská Unie snaží harmonizovat trestní sazby. A v neposlední řadě o možnosti mírnějšího postihu pro členy spolupracující s orgány činnými v trestním řízení a o možnost beztrestnosti v rámci uvažovaného institutu korunního svědka. Z této bakalářské práce je také patrné, jak významnou měrou přispěl výzkum organizovaného zločinu(prováděn převážně IKSP) a jak široce ovlivňuje mezinárodní právo a vnitřní legislativu problematiky organizovaného zločinu. Dále tato práce obsahuje historii, druhy a příčiny organizované trestné činnosti. Z druhů organizované trestné činnosti jsem podrobněji rozebral obchod se ženami, abych nastínil, jak takový organizovaný zločin funguje a jak je organizován.

Anotace v anglickém jazyce Sanctoin for criminal conspiracy according to the penal code This bachelor thesis delimits the definition of criminal conspiracy and explains the difference between a criminal conspiracy and an organized group. Sanctions of organized criminal activity are described, mainly in respect of Sec. 43 and 44, Sec. 163a to 163c of the Criminal Code. The thesis answers the question how to punish the offenders who are dangerous recidivists and commit a crime in favour of criminal conspiracy simultaneously. The thesis explains how the problem of organized crime is solved at the European level and how the European Union tries to harmonize the durations of sentences. And last but not least, the thesis deals with the possibility of a more moderate recourse for members cooperating with the bodies active in the criminal procedure and of immunity from prosecution of a target witness. It is also evident from this bachelor thesis what was the contribution of the investigation of organized crime carried out by the IKSP and how it influences the international law and the inner legislation of the problems of organized crime. The thesis also contains the history, the types and the causes of organized criminality. Within the organized criminality, the business with women is described in more details to outline its functioning and organization.
