Abstract:

Anotace Předmětem této bakalářské práce jsou hospodářské trestné činy. Cílem práce je především analýza hospodářských trestných činů se zaměřením na detailnější vysvětlení specifik trestných činů proti měně a platebním prostředkům. Lze konstatovat, že stávající právní úprava hospodářských trestných činů je dostatečná, adekvátně vycházející z aktuálních společenských potřeb. Jak totiž ukázala krátká analýza historického vývoje právní úpravy hospodářských trestných činů, tato se vždy měnila podle aktuálních společenských potřeb a požadavků, zejména pak v souvislosti s pádem komunismu a s nástupem svobodného podnikání a podnikatelské svobody. V souvislosti s právní úpravou trestných činů proti měně a platebním prostředkům je nezbytné zmínit, že tato úprava v českém trestním zákoníku odpovídá mezinárodním úmluvám na ochranu peněz proti padělání a pozměnění, kterými je Česká republika vázána.

Abstract:

Annotation The subject of this thesis are economic crimes. The aim of the work is to analyze economic crimes, focusing on a more detailed explanation of the specific offenses against the currency and means of payment. It can be concluded that the existing legislation of economic crimes is sufficient, adequately based on current social needs. As short analysis of the historical development of the law of economic crimes proved, this has always changed according to current social needs and requirements, especially in context with the collapse of communism and the onset of a free enterprise and entrepreneurial freedom. In connection with the legislation of criminal offenses against the currency and means of payment is necessary to mention that this adjustment in the Czech Criminal Code complies with international conventions on the protection of money against counterfeiting and alteration, which the Czech Republic is bound.
