Consumer Protection in contracts concluded by Distance Learning

Abstract:

Diplomová práce se věnuje ochraně spotřebitele u smluv uzavíraných distančním způsobem. Práce je členěna na dvě části, literární rešerši a vlastní práci. Literární rešerše se věnuje historickému vývoji ochrany spotřebitele a současné právní úpravě ochrany spotřebitele. Také tu nalezneme základní informace o smlouvách a pravidla při uzavírání smluv. Dále literární rešerše obsahuje problematiku týkající se spotřebitelských smluv, smluv uzavíraných distančním způsobem, spotřebitelských organizací a GDPR. Vlastní práce se věnuje nejprve komparaci spotřebitelských smluv a ilustračním případům z praxe, které jsou pojaty jak z hlediska právního, tak i ekonomického. Dále se věnuje orientační analýze a primárnímu výzkumu, který byl provedený prostřednictvím dotazníkového šetření. V závěru práce nalezneme doporučení pro spotřebitele a podnikatele, kteří využívají při podnikání distanční smlouvy.

Abstract:

The thesis deals with consumer protection in contracts concluded without a personal contact of the parties. The thesis is divided into two parts, literary research and the main body. The literature review focuses on the historical development of legislation regarding consumer protection and current legislation of consumer protection. We can also find basic contract information and contracting rules here. Furthermore, the literature research contains issues related to consumer contracts, contracts concluded in a distance manner, consumer organizations and GDPR. The main body deals with the comparison of consumer contracts and illustrative cases, which are conceived both from the legal and economic point of view. It is also devoted to analysis and primary research, which was conducted through a questionnaire survey. In conclusion, we can find recommendations for consumers and entrepreneurs, who use such contracts.
