Abstract:

Práce se zabývá problematikou soudního přezkumu legislativních aktů Evropské unie. Upozorňuje na zvláštní povahu legislativních aktů a zkoumá specifika jejich soudního přezkumu. Cílem práce je posoudit, zda je Soudní dvůr v tomto smyslu schopen plnit roli unijního ústavního soudu. Práce za tím účelem analyzuje jak institucionální a procesní rámec přezkumu, tak i jeho reálné fungování. Identifikuje přitom základní nedostatky unijního systému přezkumu legislativních aktů a snaží se nalézt jejich možná řešení.

Abstract:

The dissertation deals with the judicial review of legislative acts of the European Union. It highlights particular nature of legislative acts and explores specifics of their judicial review. The aim of the thesis is to assess whether the Court of Justice is in this sense able to fulfil the tasks of the Union's constitutional court. The text analyses both the institutional and procedural framework of the judicial review of legislative acts and also its real functioning. It identifies the main shortcomings of this system and tries to find their possible solutions.
