The Selection of a Law Applicable to Contractual Relations - Basic Comparison with the U. S. Law
Abstract:
Diplomová práce se zabývá výběrem práva rozhodného pro smluvní vztahy ve srovnání s americkým přístupem. V diplomové práci je nejdříve popsán český přístup. Následně jsou popsány jednotlivé americké přístupy: teorie nabytých práv, teorie místa nejvýznamnějšího vztahu, teorie zájmové analýzy a teorie lepšího práva. Americké přístupy jsou porovnány s českým přístupem a spolu navzájem.
Abstract:
The master thesis is dealing with selection of a law applicable to contractual relations in comparison with the U. S. law. At first, there is analyzed Czech approach in the master thesis. Then there are analyzed American approaches: vested rights approach, most significant relationship theory, interest analysis and better law approach.
