Cosumer protection in banking

Abstract:

Bakalářská práce se zaměřuje na ochranu bankovního klienta, na kterého nahlíží jako na spotřebitele. Právní regulace této ochrany je nutná především z důvodu vyrovnání existující nerovnosti mezi spotřebitelem a poskytovatelem. Práce vysvětluje, proč je bankovní klient řazen mezi spotřebitele a proč se považuje za přirozeně slabší stranu v právním vztahu. Vymezuje nejdůležitější oblasti ochrany, kterými jsou: spotřebitelské úvěry, platební styk, pojištění pohledávek z vkladů, bankovní tajemství, uvádí možnosti mimosoudních vyrovnání sporů a také zmiňuje o některých ochranářských praktikách, jako jsou etické kodexy nebo funkce bankovního ombudsmana. Na základě zkoumaných zákonu a evropských směrnic lze dospět k závěru, že ochrana spotřebitele je pokroková, dynamicky se rozšiřující oblast, která směřuje ke zpevnění důvěry spotřebitelů v bankovní sektor, posílení jeho postavení na trhu a zabezpečení náležité ochrany jeho práv a zájmů.

Abstract:

The bachelor thesis focuses on the protection of the banking client, which it views as a consumer. Legal regulation of this protection is necessary primarily to compensate for the existing inequality between the consumer and the provider. The thesis explains why a bank client is ranked among consumers and why he is considered to be a naturally weaker party in a legal relationship. It defines the most important areas of protection, such as consumer credit, payment system, deposit insurance, bank secrecy, the possibility of out-of-court settlement of disputes and also refers to certain protectionist practices such as codes of ethics or banking ombudsman. Based on the law and European directives it can be concluded that consumer protection is an advanced, dynamically expanding area aimed at strengthening consumer confidence in the banking sector, reinforcement of market position and ensuring that its rights and interests are properly protected.
