Judicial Review of the Public Administration Exercised by the Supreme Administrative Court

Abstract:

V této práci se zabývám úlohou a činností Nejvyššího správního soudu, jako vrcholného soudního oránu ve věcech správního soudnictví. Nejyvšší správní soud, byl zřízen v roce 2003 čímž došlo k zásadní reformě správního soudnictví. Nejvyššímu správnímu soudu jsou svěřeny nejvýznamnější pravomoci ve správním soudnictví. V této práci se nejdříve zabývám minulostí správního soudnictví na našem území. Poté jsem se zaměřila na postavení NSS v soustavě soudů v ČR. Organizační struktura Nejvyššího správního soudu je tématem další kapitoly. Zde je prostor pro podrobnější seznámení se s jednacím řádem Nejvyššího správního soudu. Větší pozornost věnuji funkci integrační. V rámci této části práce která je rozdělená do několika podkapitol se v prvé řadě zaměřuji na integrační funkci v rámci samotného Nejvyššího správního soudu. Poté se věnuji problematice stanovisek i zásadních usnesení, která jsou často diskutovaná v odborných článcích a literatuře. Tuto část práce uzavírám Sbírkou rozhodnutí NSS a postupem při uveřejňování rozhodnutí. Rozhodovací činnosti Nejvyššího správního soudu věnuji podstatnou část této práce, přičemž se především zaměřuji na kasační stížnost, kterou se snažím přiblížit co nejvíc detailně,vzhledem k důležitosti tohoto institutu.V samotném závěru práce se věnuji ostatním formám řízení před Nejvyšším správním soudem. Jde hlavně o problematiku kompetenčních sporů a řízení o zrušení opatření obecné povahy nebo jeho části. Na závěr této práce se věnuji i řízení ve věcech politických stran a hnutí a řízení ve věcech volebních.

Abstract:

In this theses I mainly occupy myself with the role of the Supreme Administrative Court as the top judicial body in the matters of the administrative justice. Administrative courts are the law guarantors of the relations between the public authority and the citizens. Administrative regulations of the court were put into effect on the 1st of January 2003. The Supreme Administrative Court was established after a long expectatin on their bases as the top judicial body, which ten years later resulted in the impletion of the Paragraph n. 91 Article n. 1 of the Constitution of the Czech Republic. As anticipated from such a high ranked judicial body, the Supreme Court is entrusted with the most influential decisions within the administrative justice. Above all, the Supreme Court ensures the unity and lawfulness of decision making, primarily by the decision making in cassation appeals. Not less significant is the unifying role when the Supreme Administrative Court monitors and assesses legitimate decisions of the regional courts and adopts viewpoints on their bases. At the beginning of this thesis, I briefly look back upon the history of the administrative justice dating back to the administrative justice of Austria – Hungary, through the period of the First Republic, further more the not very favourable period of normalization, up to the 1990s.Next part of my thesis focuses on the position of the Supreme Administrative Court in the judicial system of the Czech Republic, whereas the attention is paid particularly to the realation of the Supreme Court and the Constitutional Court. Following chapter of the thesis deals with the organizational structure of the Supreme Administrative Court and the rules of procedure of the Supreme Administrative Court. However, I pay particular attention to one of its most important roles, which is the integrative role. Within this chapter, which is divided into several subchapters, I primarily focus on the integrative function within the frame of the Supreme Administrative Court. Afterwards, I attend to the questions of viewpoints and crucial judicial decisions, which are often discussed in papers and specialized literature. This section is concluded with the Compilation of verdicts of the Supreme Administrative Court and the precedure of publishing legal verdicts.The major part of the thesis is dedicated to the decision making activities of the Supreme Administrative Court, mainly to the cassation appeal which I try to explain in greater detail with regard to the importance of this institute.The final chapter covers with other forms of proceedings at the Supreme Administrative Court, primarily, the issues of questions of judicare publication and the issue of proceedings during cancellation of common character measures or one of their parts. Furthermore, this part also deals with the proceedings in the cases of political parties, movements and proceedings of electoral cases. The two last mentioned issues are related to the Constitutional Justice, so they are not delt with in detail. Nevertheles, I believe, that they are related to this theme, and therefore are mentioned in my thesis
