Direct Presidential Election

Abstract:

Diplomová práce je tematicky zaměřena na přímou volbu prezidenta v České republice. První část práce se věnuje obecným pojmům, jako jsou rozdíly mezi přímou a nepřímou volbou prezidenta a argumentům pro i proti zavedení volby přímé. Dále je v první části popsána geneze tohoto ústavního institutu, jak z hlediska historického, tak i z hlediska snah o jeho přijímání. Druhá část práce je věnována vybranému institu-tu přímé volby, způsobu navrhování kandidátů pro volby prezidenta republiky a identifikaci problémů tohoto institutu. Třetí část práce poté navazuje na část druhou, jsou v ní analyzována soudní rozhodnutí sou-visející s navrhováním kandidátů a problémy identifikovanými v části druhé. V závěru práce jsou též navrženy změny de lege ferenda, které by do budoucna mohly přispět k hladšímu průběhu navrhování kandidátů.

Abstract:

The thematic focus of the thesis is focused on direct presidential elec-tions in the Czech Republic. First part of the text is dedicated to general concepts of the presidential elections, such as differences among direct and indirect presidential elections and to arguments in favour of and against establishing direct elections. In addition, the focus is held on the genesis of this constitutional institute from the historical point of view as well as from the point of view of implementation efforts for its estab-lishing. The second part of the text focuses on the selected institute of direct election – nomination of candidates and on identification of its main issues. What is more these issues are analysed in the third part of the text through analyses of case law related to the nomination of can-didates and problems already identified in the second part of the work. In addition, possible proposals for change of applicable legislation are mentioned in the conclusion of this work.
