Actual Problems of Administrative Justice

Abstract:

Cílem mé bakalářské práce na téma Aktuální otázky správního soudnictví je nabídnout přehled o správním soudnictví. Snažím se zde objasnit základní definice a problémy, se kterými se v současnosti správní soudnictví potýká. Je zde uplatňován zákon č. 150/2002 Sb., soudní řád správní ve znění pozdějších předpisů. Po stručném úvodu následuje druhá kapitola, kde se zabývám správním soudnictvím, především vymezením pojmu a funkce, kde prezentuji názory našich odborníků na dané téma. Třetí kapitola se zabývá historií správního soudnictví, kde směřuji pozornost k novele, která má účinnost od 1. 1. 2012, v níž rozepisuji nejdůležitější novinky, které obsahuje. Dále zde popisuji historii v některých dalších zemích. Zde jsem vylíčila modely zemí z hlediska historického i novodobého. Ve čtvrté kapitole se věnuji pramenům právní úpravy. Vyjmenovala jsem zde důležitou ústavní a zákonnou úpravu. V páté kapitole začíná stěžejní část mé práce, kdy se rozepisuji o soustavě soudů. Popisuji zde krajské soudy jako soudy správní, jejich pravomoc, organizaci. Více se však věnuji Nejvyššímu správnímu soudu, kdy jeho pravomoc a organizaci rozebírám podrobněji. Další podkapitolou je Sjednocování judikatury, zde mám vypsané dva judikáty, které podle mě vypovídají za vše. Snažím se nastínit i význam judikatury Evropského soudního dvora, ale to jen velmi okrajově. V šesté kapitole pokračuje stěžejní část mé práce, pojednávám zde o řízeních ve správním soudnictví. Vypisuji zde jednotlivé žaloby a k nim přikládám i jednotlivé judikáty, které mě zaujaly. Sedmá kapitola je věnována opravným prostředkům. Ve správním soudnictví jsou možné jen mimořádné opravné prostředky, což jsou kasační stížnost a obnova řízení. V osmé kapitole se věnuji námětu de lege ferenda, kde se snažím nastínit, dle mého názoru problém absence řádného opravného prostředku. Následuje závěr, kde nabízím určité zhodnocení. Téma je to rozsáhlé a tak jsem se nemohla detailně věnovat všem aspektům správního soudnictví.

Abstract:

The aim of my bachelor thesis Current Issues of the Administrative Judiciary is to give an overview of the administrative judiciary. I attempted to elucidate essential definitions and issues the administrative judiciary currently deals with. The Law No 150/2002 Sb. on Administrative Procedure (Zákon č. 150/2002 Sb., soudní řád správní) and subsequent amendments to the Directive are applied here. A brief introduction is followed by the second chapter in which I focus on administrative judiciary, especially by defining a concept and a function where I present opinion of our experts on the set topic. The third chapter deals with the history of administrative judiciary and I look into the amendment of the law which is in force since January 1st, 2012, and I describe the most important innovations the amendment has brought. I also write about the history in other countries. I depict models of the countries with respect to history as well as to the present. In the fourth chapter I occupied myself with sources of legal provisions. I specified the important institutional and statutory provision. With the fifth chapter the crucial part of my thesis begins, as I write about the system of courts in detail. I describe county courts as administrative courts, their jurisdiction and organization. I focus on Supreme Administrative Court and on its jurisdiction and organization in greater detail. Another subchapter is The Unification of Jurisdiction where I delineate two judicial decisions which, in my opinion, speak volumes. I try to depict also the purpose of the practice of the European Court of Justice, but only marginally. The crucial part of the thesis continues in the sixth chapter of my thesis, as I discuss proceedings in the administrative judiciary there. I list particular legal actions and enclose the judicial decisions which were interesting for me. In the seventh chapter, I focus on legal remedies. It is possible to use only special appeals in the administrative jurisdiction, which includes a cassation appeal and a revision of judgement. I discuss the proposal of de lege ferenda in the eighth chapter and I try to outline what I think the problem of an absence of an ordinary appeal is. The closing chapter follows in which I offer certain assessment. The topic is very extensive and that is the reason I could not focus on all aspects of the administrative jurisdiction in detail.
