The International Adoptions in Accordance with the Hague Convention on the Protection of Children and Co-operation in Respect of Intercountry Adoption

Abstract:

Cieľom tejto práce je okrem poskytnutia základného prehľadu o procese sprostredkovania medzinárodného osvojenia podľa Haagskeho Dohovoru o ochrane detí a spolupráci pri medzinárodnom osvojení, poukázať najmä na citlivosť témy medzinárodného osvojenia, ktoré môže na jednej strane ponúknuť životnú šancu vyrastať v rodine deťom, o ktoré je menší záujem v rámci národného systému osvojenia, na druhej strane však vzhľadom k veľkému záujmu o osvojenie dieťaťa vo vyspelých krajinách býva často podnetom k únosom, predaju a k obchodovaniu s deťmi. V práci budú analyzované najmä princíp subsidiarity medzinárodného osvojenia, základné podmienky osvojenia do cudziny podľa Dohovoru, ktoré musia byť splnené na strane dieťaťa a na strane osvojiteľov, prípady obchádzania Dohovoru, ktoré sa vyskytli v praxi ako i problematika uznania rozhodnutia o osvojení a jeho účinky v zmluvných štátoch.

Abstract:

The aim of this work is besides providing a basic overview about the process of mediation of intercountry adoption in accordance with the Hague Convention on International Protection of Children and Co-operation in Respect of Intercountry Adoption to highlight especially the sensitiveness of the subject of intercountry adoption. On the one hand intercountry adoption can namely offer children without parents, who can not be placed in a suitable family within national adoption system a chance to grow up in a family, on the other hand however owing to a big interest in adopting a child from abroad in several well-developed countries there have been cases of abusing intercountry adoption for commercial purposes, which has led to abduction, sale and trafficking in children. This work analyses especially the principle of subsidiarity of intercountry adoption, the basic requirements for adopting a child from another country concerning the child as well as the adoptive parents, cases of avoiding the Convention, which occurred in the practice as well as the issue of recognition of decision on adoption and its effects in other contracting states.
