Abstract:

Tato práce se zabývá náhradou nákladů řízení. Náklady řízení jsou nezbytnou součástí každého soudního řízení, jak samotné placení náklady, tak na i následná náhradu nákladů účastníků řízení. Práce je rozdělena do pět hlavních kapitol. První obsahuje úvod do dané problematiky a následuje kapitola obsahující přehled nejčastějších nákladů řízení, se kterými se mohou účastníci řízení setkat, jako jsou například poplatky za právní zastoupení, ušlý zisk, náklady na dokazování a odměna advokátovi. Další tři kapitoly obsahují práva a povinnosti v řízení vyplývající z povinnosti k náhradě nákladů řízení, povinnosti k náhradě nákladů řízení a povinnosti soudu o nich rozhodnout. Povinnost nahradit náklady je založena především na zásadě úspěchu ve věci. V práci jsou zmíněny i další možnosti, které nejsou tak časté jako princip úspěchu ve věci. Je třeba také zmínit, že soud má svá vlastní práva rozhodnout, že náhrada nemusí být provedena. Práce kombinuje základní právní předpisy a ustálenou judikaturu pro lepší pochopení samotné náhrady nákladů řízení.

Abstract:

This thesis deals with reimbursement of trial costs and the main. The cost of civil proceeding is necessary part of every legal proceeding, this includes on one hand paying and on the other hand reimbursing of costs by the subjects of the civil proceeding. The thesis is divided into five main chapters. The first contains the introduction to the topic followed by next chapter containing summary of the most common costs of the proceedings which the participants of trial may encounter such as legal fees, lost profit, the cost for proof and reward for the advocate. Next three chapters contains rights and duties in the proceeding which arise from the duty to pay the costs, the duty to reimburse the costs of the proceeding and the duty of the court to decide. The duty of reimbursing the costs is mainly based on the principle of success in the case. There are other possibilities which are also mentioned in the thesis which are not as common as the principle of success in the case. Also, to be mentioned, the court has its own rights to decide that the reimbursement does not have to be accomplished. The thesis combines essential legal regulations and established case law for better understanding of the reimbursement of trial costs.
