Punishing adolescents - crimes committed by juveniles

Abstract:

Práce se zabývá problematikou vztahu mezi věkovou hranicí trestní odpovědnosti (VHTO) a kriminalitou dětí a mládeže. Z této široké oblasti pak detailněji zpracovává otázky spojené s nastavením VHTO. Krátce jsou shrnuty přístupy k VHTO v zahraničí (včetně tamních dopadů na kriminalitu) a také historický vývoj v České republice. Výraznější pozornost je věnována průběhu a obsahu veřejných diskusí, které vznikly kolem VHTO v posledních dvaceti letech. Na základě starších zdrojů, především výsledků výzkumů veřejného mínění, je konstatováno, že v České republice existuje společenská objednávka po změnách v oblasti VHTO. Ta má dvě podoby. Za prvé lze hovořit o poptávce po snížení VHTO, přičemž významná část společnosti preferuje různé režimy pro případy závažných zločinů a pro případy ostatní. Za druhé je možné detekovat poptávku po celkovém zpřísnění prostředí a po sblížení trestních sazeb, jaké jsou určeny pro mladistvé s trestními sazbami pro dospělé. Práce krátce analyzuje důvody, které vyvolávají tuto poptávku. Vlastní výzkum byl uskutečněn pomocí dotazníkového šetření mezi několika skupinami odborníků z praxe. Otázky se zaměřily především na změny VHTO. Výsledky výzkumu jsou konfrontovány se společenskými náladami. Závěrem práce jsou pak doporučení pro další směřování společenské diskuse a odpovědi na otázky položené v rámci definování cíle práce.

Abstract:

This bachelor thesis deals with the relationship between the age of criminal liability and the criminality of children and youth. Questions connected with the adjustment of the criminal liability are detailed in the thesis. The stances on the age of criminal liability abroad are summarized shortly (including the impact on the local criminality level) and a historical development in the Czech republic. Closer attention is paid to the course and content of public discussions which developed around the age of criminal liability in the last twenty years. Based on older sources, primarily results of public opinion researches, it is stated, that there exists a social requisition for changes in the age of criminal liability. This has two forms. In the first place, it is possible to talk about the demand for reduction of the age of criminal liability, when a significant part of the society prefers two different modes for the events of a serious crime and for the other cases. Secondly, it is possible to detect the demand for an overall tightening of the environment and approximating of penalty rates, that are intended for the youth with the penalty rates for adults. The thesis shortly analyses the reasons that cause this demand. Own research was realized through a survey among several groups of practitioners. The questions were focused above all on changes in the age of criminal liability. Results of this research are confronted with the social mood. In conclusion of this bachelor thesis there is a suggestion for a further direction of a social discussion and answers for the questions asked within defining a goal of this thesis.
